SAN JUAN COUNTY COMMISSION MEETING AUGUST 14, 2006 The regular meeting of the San Juan County commission was held on August 14, 2006 at 10:00 A.M. in the Commission room at Monticello, Utah Present: Lynn Stevens, Chairman Manuel Morgan, Vice Chairman Bruce Adams, Commissioner Rick Bailey, SJC Administrator Norman Johnson, SJC Clerk/Auditor Dianne F. Neuss, SJC Deputy Clerk Commissioner Bruce Adams made a motion to approve the minutes of July 31, 2006. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Rick Bailey - SJC Administrator - Reaffirmation of Previous Emergency Declarations Rick requested approval and signature for a document reaffirming the Emergency Declarations previously approved. The Emergency Declarations approved are for assistance for the Navajo Mountain Wildland Fire and for the drought situation throughout San Juan County. The declarations were approved on June 14th and on June 26th, respectively. Commissioner Bruce Adams made a motion to approve and sign the Reaffirmation of the previously approved Emergency Declarations. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. REAFFIRMATION OF PREVIOUS EMERGENCY DECLARATIONS The San Juan County Commissioner hereby reaffirms the two emergency declarations previously approved regarding the emergency situation in San Juan County, Utah. These situations include the emergency declaration approved on June 14, 2006 covering the drought situation throughout San Juan County. The County is currently facilitating emergency response activities in Navajo Mountain in which the culinary water system has been adversely affected by the residue from the Navajo Mountain Wildland Fire. The County has been hauling culinary water and providing bottle water to the residents of the area. The County officially requests the emergency response capabilities and financial assistance of the State of Utah to meet the needs of the local residents and schools in Navajo Mountain. The County also officially requests the assistance of the Utah Congressional Delegation in securing emergency funding in the amount of $2,000,000.00 to $2,500,000.00 to complete the construction of the Indian Health Service water line from Inscription House to the Navajo Mountain Community. Adams, Commissioner Attachments: Previous Declarations Sandy Meyers - Monticello BLM Sandy requested an informal meeting with the Commission to address "Save America's Treasures." The meeting is set for next Monday, August 21st at 9:00 a.m. Sandy also wanted to touch bases with the Commission regarding the initiative with the Sonoran Institute to work on partnerships to enhance tourism and other issues. She stated that she received an e-mail from National Geographic offering participation but their initiative only addresses tourism and there is a cost to the County to participate. The initiative offered by the Sonoran Institute addresses tourism and other broader range issues and there is no cost to the County. She would like to discuss this at next Monday's meeting. Cyndi Eldredge - SJC Personnel Office Cyndi requested approval of a recommendation to hire Lyle Bayles for the Drug Task Force Grant Manager. This is a part time position, step 194. Sheriff Mike Lacy was in agreement with the recommendation. Commissioner Bruce Adams made a motion to approve hiring Lyle Bayles for the Drug Task Force Grant Manager. Commissioner Manuel Morgan seconded to motion. Commissioner Lynn Stevens declared the motion carried. Cyndi requested approval of a recommendation to hire Marcia Shumway for the position of Secretary/Dispatcher/Matron in the Sheriff's department. She has been on an extended leave of absence since October 14, 2005 and all personal leave was paid out at that time. She will return at the same rate of pay, step 89, as when she left on leave. Commissioner Bruce Adams made a motion to approve hiring Marcia Shumway for the position of Secretary/Dispatcher/Matron in the Sheriff's department. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Cyndi presented the Comprehensive Health and Safety Program for Commission approval. She and Rick Bailey developed the program which has been approved by the Utah Insurance Pool. Cyndi said that it has been very well received and may be used by others to develop safety programs. She will provide Commissioners with a copy of the program. Cyndi stated that work related compensation is down significantly compared to last year and that she is planing training sessions based on the new program. Commissioner Manuel Morgan made a motion to approve the Comprehensive Health and Safety Program and authorized Commissioner Stevens to sign the document. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried with the understanding that Commissioners will review the Program. THE ENTIRE COMPREHENSIVE HEALTH AND SAFETY PROGRAM IS AN ATTACHMENT TO THE MINUTES OF THE COUNTY COMMISSION. Sheriff Mike Lacy - Domestic Violence Grant Sheriff Lacy presented a Grant request for approval from the San Juan Domestic Violence Coalition (Cynthia Black, Chair and Lou Mueller Co-Chair) to the Utah Domestic Violence Council in Salt Lake City. The request is in the amount of $2,000 to be used for various public awareness publications, videos, training, advocacy and other related expenses from October of 2006 to October of 2007. Commissioner Manuel Morgan made a motion to approve the grant application. Commissioner Bruce Adams seconded the motion. Commissioner Manuel Morgan declared the motion carried. Commissioner Stevens was absent for the vote. Rick requested approval for a Contract Amendment between the State of Utah and the Utah Navajo Revitalization Fund. The contract ending date was changed from 3/31/2004 to 6/30/2007; the contract amount remained the same at $170,000. The effective date of Amendment is August 7, 2006. Rick requested approval of a Contract for Legal Services between Utah Legal Services, Incorporated and San Juan County Area Agency on Aging effective July 1, 2006 until June 30, 2007. Rick also presented two additional Contracts between the Utah Department of Human Services and the Division of Aging and Adult Services for DHS Pass Through and Medicaid Aging Waiver Services. Commissioner Manuel Morgan made a motion to approve the Contracts for Legal Services, DHS Pass Through and Medicaid Aging Waiver Service. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried. Rick and Commissioner Bruce Adams attended an Ad hoc meeting with Grand County concerning Spanish Valley sewer and water issues. It was agreed by members of both Counties to contact SITLA to request a cost feasibility study for a sewage plant in the area. Delivery of culinary water was also brought up but it was decided that without Water District representatives present, they would not discuss the issue at this time. Commissioner Adams said that there was good representation and participation at the meeting. Rick presented a Resolution for approval and authorization of the execution of an Amended Interlocal Cooperation Agreement with other members of Utah Counties Insurance Pool, relating to the establishment, funding and operation of Utah Counties Insurance Pool. Commissioner Bruce Adams made a motion to approve and authorize the execution of an Amended Interlocal Cooperation Agreement. Commissioner Manuel Morgan seconded the motion. RESOLUTION NO. 2006-04 RESOLUTION APPROVING AND AUTHORIZING THE EXECUTION OF AN AMENDED INTERLOCAL COOPERATION AGREEMENT WITH OTHER MEMBERS OF UTAH COUNTIES INSURANCE POOL, RELATING TO THE ESTABLISHMENT, FUNDING AND OPERATION OF UTAH COUNTIES INSURANCE POOL WHEREAS, pursuant to the provisions of the Interlocal Cooperation Act, Title 11, chapter 13, Utah Code annotated, 1953 as amended, and the Utah Insurance code, Title 31A, Chapter 1 et seq, Utah Code annotated, 1953 as amended, public agencies, including political subdivisions of the State of Utah as therein defined, are authorized to enter into mutually advantageous agreements to provide services and facilities; and WHEREAS, the Board of County Commission of San Juan County, Utah, has determined that the interests and welfare of the public within San Juan County's jurisdiction will best be served by an Amended Interlocal Cooperation Agreement with other members of Utah counties Insurance Pool relating to the establishment, funding and operation of Utah Counties Insurance Pool. NOW, THEREFORE, be it resolved by the Board of County Commission of San Juan County, Utah, that San Juan County approve and authorize the Commission Chair to execute an Amended Interlocal Cooperation Agreement with other member of Utah Counties Insurance Pool relating to the establishment, funding and operation of Utah Counties Insurance Pool. New CPR Prompt 7-Pack for the Emergency Medical Service from Mass Group, Inc. in the amount of $388.00. Commissioner Bruce Adams made a motion to approve the procurements. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Rick said that the Bluff Fire Station is now completed and they will hold an open-house on Sunday, August 20th at 4:00 p.m. Rick said that he is very pleased with the construction of the building and with the process. Rick reported that he and Lynn Laws accompanied representatives from Congressman Matheson's office and from the Washington, D.C. Office of Public Lands, on a tour of roads that have been improved with the use of Navajo Nation funds. They were very pleased with what has been done. He also said that the BIA has agreed to work on the road from Red Mesa to Montezuma Creek. The Commission thanked Rick and Lynn for their efforts. Rick discussed the problems with the water system at Navajo Mountain in the aftermath of the fire. He said that the ash from the fire and the rain is causing major clogging of the water system. Although they have been delivering bottled water as well as trucking water to the area, there are still major problems. Rick said he has been in touch with the State Public Safety people requesting help in the form of funding, but they have not been responsive to his requests. He is trying to get help for this problem from the State as well as from the Navajo Nation but the County has been the only source of funding for this emergency situation. Rick also contacted Senator Hatch's office for help. In addition, the ten-mile road to the area is extremely rough and making it difficult to transport water to the area. He said that it will take approximately two years before the road is repaired. An affidavit will be prepared by Walter Bird to The Radiation Control Board, Utah Department of Environmental Quality, to address the Sierra Club's Challenge to the White Mesa Mill Alternate Feed Proposal. The affidavit will ask the Board to reject the Sierra Club's statement that they represent the people of San Juan County. The mill and its feed sources are supported by the San Juan County Commission who are the elected representatives of the citizens of San Juan County. Commissioner Bruce Adams made a motion to sign an affidavit stating the Commission's objections to the Environmental Group's Claims. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. 11:00 A.M. - Open Bids for Monument Valley Fire Station Access Road. Rick presented one bid submitted in writing by LeGrand Johnson Construction Company for the Monument Valley Fire Station Access Road project. There were no other bids for this project. After the bid is reviewed, it will be presented to the Commission for approval. Cleal Bradford and Brian Torgenson - Twin Rocks Amphitheater Site Cleal discussed the history of the San Juan Foundation's purchase of State lands to build an Amphitheater in Bluff, Utah. The Bluff Special Service District expressed their desire for ownership to revert to them in the event of default. Previously an action was taken by the San Juan County Commission to take over ownership of the property if it should go into default. Walter Bird, Attorney saw no problem with Bluff owning property and Brian Torgenson said that SITLA would have no objection to Bluff being in the default position. The Commission meeting minutes will be reviewed to determine exactly what the original decision was on this issue and will be addressed again at next week's Commission Meeting. Other issues such as restrictions and contact with surrounding residents concerning the plans were also discussed. 11:30 - Public Hearing - Consideration of Vacating a Segment of County Road #176 and County road #154. Commissioner Bruce Adams made a motion to enter into Public Hearing. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. A Public Hearing was held to address the request to vacate a roughly 2.0 mile segment of County Road #176 beginning at the junction of County Road #176 and County Road #154. Walter Bird, Attorney, presented a map to the Commission showing the area and explained in detail the request and the Ordinance relating to the change. The plan is to abandon one part of the road and adopt another part of the road. After discussion, and since there were no objections to this request, a vote was taken. Commissioner Manuel Morgan made a motion to exit the Public Hearing. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried. Ordinance No. 2006-02 ORDINANCE TO VACATE A 2.0 MILE SEGMENT OF COUNTY ROAD #176 AND PERMANENTLY CLOSE THE SEGMENT TO PUBLIC ACCESS AND TRAVEL WHEREAS, County Road #176 is situated in the northeast corner of San Juan County running approximately 8.9 miles in a southeasterly direction from Grand County, Utah, to the Colorado state line. WHEREAS, County Road #176 is a state class B road. WHEREAS, it has been recommended by the Utah Division of Wildlife Resources (UDWR) that a 2.0 mile segment of County Road #176, beginning at the junction of County Road #176 and County Road #154, and running northeast to southeast along Geyser Creek to the point where Geyser Creek flows south and County Road #176 continues east, be vacated and realigned to protect fish and wildlife in and along Geyser Creek. WHEREAS, the proposed vacation is to be replaced by a 2.10 mile segment, north of the existing right-of-way, via a deed from Paul Redd, LaSal, Utah to San Juan County, to be executed immediately after the proposed vacation. WHEREAS, pursuant to state law, the "[t]he county governing body exercises sole jurisdiction and control of county roads within the county." Section 72-3-103(4), U.C.A. (1953, as amended). WHEREAS, pursuant to state law, "[a] county may by ordinance vacate, narrow, or change the name of a county road without petition or after petition by a property owner." Section 72-3-108(1), U.C.A. (1953, as amended). NOW, THEREFORE, BE IT ORDAINED BY THE COUNTY LEGISLATIVE BODY OF SAN JUAN COUNTY, UTAH, THAT: Due to concerns for fish and wildlife in and along the 2.0 mile segment of County Road #176 described above, this segment shall be vacated and permanently closed to public access and travel to be replaced by a 2.10 mile right-of-way segment to be deeded to San Juan County immediately after the vacation as to insure that the traveling public is not inconvenienced. Commissioner Lynn Stevens declared to motion carried. Sandra Asbury - Preservation of Historic Structures Sandra's request for assistance from the County was reviewed by the Commission. It was decided that the building permit fees for the donated cabins will be waived by the County. The County will also provide pilot cars when the buildings are being moved. They advised Sandra to meet with our new Economic Development Director, Charles DeLorme, to try and locate funding to move one of the cabins (approximate cost $5,000) to her property. Rick will speak to Charles regarding this issue. Open Time and Other Business David Carpenter of the Bluff Service District advised the Commission that they will be attending the Water Quality Board Meeting on Friday to present their request for funding for the Bluff Sewer Project. Commissioner Lynn Stevens would like to attend and David will e-mail him the time and place of the meeting. Greg Martin, Assistant Manager City of Monticello, gave a short status report concerning the wind study effort. Three towers are due to arrive this week and should be erected on August 21st and 22nd. Wasatch Wind will collect the information from the towers. Two of the sites for the towers are on SITLA land and the other is on private property. Commissioner Bruce Adams along with Greg will visit the land owner and request the use of his land. A three-year agreement, providing a $500 a year stipend for use of the land will be offered. Since the City's budget has run out for the project, Commissioner Bruce Adams requested that the County provide $500 to pay for one year's stipend. Commissioner Bruce Adams made a motion to provide $500 to be used for compensation for use of private property for the wind project. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Commissioner Lynn Stevens will be in Salt Lake City attending meetings this week with members of the State Department of Natural Resources, the State Department of Agriculture and Food and with the Lieutenant Governor, regarding grazing permits and road closures. He will attend the Water Quality Board Meeting on Friday.
