SAN JUAN COUNTY COMMISSION MEETING August 21, 2006 The regular meeting of the San Juan County Commission was held on August 21, 2006 at 10:00 A.M. in the Commission Room at Monticello, Utah Present: Lynn Stevens, Chairman Manuel Morgan, Vice Chairman Bruce Adams, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk/Auditor Dianne F. Neuss, SJC Deputy Clerk Commissioner Bruce Adams made a motion to approve the minutes of August 14, 2006 subject to changes. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. John Fellmeth - SJC Information Services - Out of State Travel John requested authorization for out of state travel to Las Vegas to attend the Caselle Conference. The conference is held annually and will take place from 10/17/06 through 10/20/06. John is especially interested in attending this year because the focus will be on the new upgrades to their accounting software. After attending the meeting, he will be better able to determine if it would be an advantage to upgrade the existing program. John will report to the Commission on his findings when he returns. Commissioner Bruce Adams made a motion to approve the out of state travel request. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Evan Lowry - Planning Office Evan reported that the BLM has named a new director for the Utah State Office. Selma Sierra will replace Henri Bisson who has been Acting Director. She will assume her duties sometime in the fall. Evan reported that Mark Smith, who represents the Jeep Jamboree, is still concerned about their planned use of Arch Canyon next year. He said that he had received a letter from the BLM requesting information about their planned trip. Commissioner Stevens requested that Evan obtain a copy of the letter and fax it to his office in SLC. In the meantime, Evan will contact Mark Smith and let him know the County's position on Arch Canyon. Jody Shumway has not begun her work getting affidavits on the B-roads as yet. Evan will check with her to see when she will begin the project. Wildlife Ecologist, Charles Kay, will be here this week looking at Forest Service wildlife information and maps. Evan attended the Rural Summit in Cedar City and said that the overall conference was good. Commissioner Stevens asked Evan if he had contacted John Harja concerning our position on the Forest Service Roadless area. Evan responded that he had made some contact with him, but that he had concerns about the ecological changes that have taken place over time and the inability to address this in a roadless area. He said that he would make further contact with John Harja and brief him on our concerns Rick Bailey - SJC Administrator Rick presented four building permits for approval and signature. Ronald Dickerson - 24 Katie Court, La Sal - Garage Jeffery Galley - 16 E. Merriam Court, Spanish Valley - Manufactured Home Guy Thompson - 277 W. Rio Grande Dr., Spanish Valley - Manufactured Home Bryan Goode - 17 E. Merriam Court, Spanish Valley - Garage Commissioner Bruce Adams made a motion to approve the building permits provided that all appropriate signatures are placed. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Rick presented an Agreement for approval between UDOT and the County for the Montezuma Creek Road Road Project. This project includes building sidewalks, curbs and gutters between the high school and elementary school. Commissioner Manuel Morgan made a motion to approve the Agreement for the Montezuma Creek Road Safety Project. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried. A quote for a Wastewater Treatment Plant Feasibility Study for the Spanish Valley area was received from John L. Chartier of Sunrise Engineering, Inc. The quote for the study was in the amount of $41,500. Rick suggested that we ask SITLA to contribute $20,000 toward the cost of this study and with a contribution of $10,000 from San Juan County and $10,000 from Grand County we could match SITLA's contribution. Tri-Hurst Construction, Incorporated submitted the low bid for construction of the Monument Valley Fire Station in the amount of $487,555. Another bid in the amount of $691,000 was received from D & K Construction Management Incorporated of Utah. The project will be funded from the General Fund and from Revitalization funds. Commissioner Bruce Adams made a motion to approve the bid from Tri Hurst in the amount of $487,555 for constriction of the Monument Valley Fire Station. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. The bid from LeGrand Johnson for the Monument Valley Access Road was reviewed. An adjustment was made to the original quote for the project with a savings of $93,485. The final quote came in at $628,269. The time frame and funding for the project was discussed. Fifty percent of the cost will be paid from B-road funds and the other half from the Transportation District. Commissioner Adams inquired about the use of B-road funding for this project. Lynn Laws researched this issue and determined that B-road funds can be utilized for the project. Commissioner Manuel Morgan made a motion to approve the bid from LeGrand Johnson in the amount of $628,269. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried. Rick reported that the water problems at Navajo Mountain are stable at this time. He said that there is still work being done but that the tanks were filling well. San Juan County, Walmart and the Red Cross supplied bottled water to the area. On Friday Representative Brad King suggested calling representatives from the LDS Church for their help and they responded by delivering 18,000 bottles of refrigerated water on Saturday. Any water that is left will be kept in reserve for back up. Lieutenant Governor Gary Herbert, Scott Duncan, Brad King, Commissioners Stevens and Adams along with Leo Manheimer of the Chapter visited the area and identified many problems that still need to be addressed. In addition, Rick spoke to representatives in Senator Hatch's office this morning about the problem and with members of the State Department of Public Safety. The State Department of Public Safety is expecting a request from the County for reimbursement of money spent. Rick will attend the UAC Meeting in Cedar City and will speak to members regarding the need for the State to help with the cost of the Navajo Mountain emergency. Lynn Laws - SJC Road Department Lynn requested approval to purchase two tool boxes with combined fuel tanks. The ones they purchased previously have held up very well. The total cost for the two is $1,100. Commissioner Bruce Adams made a motion to approve the purchase of the tool boxes with combined fuel tanks. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Lynn also requested Commission approval to change the supplier of culverts to the County because the company increased their prices to much more than they originally quoted and are also now charging $2,000 per truck load for transportation of the pipe. Lynn recommends going with Contech Construction Products, Inc. whose prices are lower for both material and transportation. They will also guarantee their pricing for the next three months. If the change is approved, Lynn would like to purchase an additional truckload of pipe to take advantage of the current lower price. Commissioner Bruce Adams made a motion to approve the change and to purchase an additional truckload of pipe. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried. Cleal Bradford - Twin Rocks Amphitheater Before addressing the issue of default ownership of the Twin Rocks Amphitheater site, Cleal Bradford requested the Commission to sponsor and support a new application for a grant from UDOT Transportation Enhancement. The grant application requested funding for the Hole-In- The-Rock Foundation to develop the Bluff Fort Historical site. A letter of support from San Juan County was included in the original application but the request was turned down because the site for the building was determined to be "high risk". The new amended grant request is to build the Fort on another location nearby. The application will name San Juan County as the primary sponsor and the Foundation as the co-sponsor of the project. A letter of support to include with the application was also requested. The County will not incur any cost in sponsoring the grant. Commissioner Stevens said that if a letter from the Governor would be helpful, he will request it. Another suggestion was made that the Bluff Special Service District may be willing to apply for CIB funding to help with the cost of this project. Cleal will pursue this suggestion. Commissioner Manuel Morgan made a motion to approve support and sponsorship of the grant request. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried. Norman Johnson researched but could not find a reference in the previous Commission Minutes regarding default ownership of the Amphitheater and grounds. The Bluff Special Service District expressed their desire to be in the default ownership position with San Juan County in the second position. Neither SITLA or Attorney Walter Bird had objections to this request. Cleal noted that one of the restrictions related to SITLA deeding the land for the project was a requirement for a water drainage study. He is hopeful that this may be something that can be added to an existing Bluff water project. Commissioner Manuel Morgan made a motion to approve the default ownership change to the Bluff Special Service District with San Juan County in the second position. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried. Commissioner Bruce Adams asked Cleal if he would be willing to write a grant application to the UDOT Transportation Enhancement for a project involving a paved bike path and walk way to Gouldings. Commissioner Adams has already met with community members regarding the project. Cleal agreed to help write the grant application and a meeting will be arranged to discuss the project further. Open Time and Other Business Norman reported that there is approximately $1,000 in the Economic Development Department budget this year to possibly help with the Transition Preservation project. The County waived building permits for the project and will provide escort vehicles when the cabins are being moved. Commissioner Stevens left a message for Steve Palmer inquiring about the need to move the donated cabins this year, but he has not responded as yet. Norman reported that Brenda Harvey forwarded information about the Navajo Fair and flyers have been posted around the building. The group discussed the status of the fair ground repairs and advertisement of the fair. The fair will take place August 25th through the 27th in Bluff. David Carpenter reported that he presented the request for funding for the Bluff Sewer Project to the Division of Water Quality Board last Friday in Salt Lake City and that the Board approved advance planning funding for the project. Commissioner's Reports Commissioner Stevens and Commissioner Adams accompanied the Lieutenant Governor and members of the State Safety representatives to Navajo Mountain to look first hand at the problems there. Commissioner Stevens will attend a meeting tomorrow regarding Natural Resources. The group will address wildlife and grazing issues. The Lieutenant Governor, Dan Fay and other privately funded wildlife organization representatives from around the State will be in attendance. Commissioner Stevens is concerned that people in the business be allowed to maintain their livestock. Commissioner Stevens will attend the Canyon County Partnership meeting in Moab this Thursday. There will be a Grand Opening of the Lisbon Valley Copper Mill on October 14th. The Lieutenant Governor will try to attend. Commissioner Bruce Adams attended a meeting with Sandy Meyers of the BLM this morning regarding the Partnership initiative with the Sonora Institute addressing tourism and other broader opportunities for partnership. The initial meeting to determine the focus of the partnership was with Sandy. Commissioner Adams encouraged our Economic Development office and the Cities of Monticello and Blanding to become involved in this initiative. Commissioner Adams said that the Anemometer towers have arrived for the wind study project and will be installed this week. Arrangements have been made with the private property owner and he has agreed to allow for one tower to be placed on his property. The other two will be on SITLA land. One will be placed on the east side and two will be placed on the north side within ten miles of Monticello. Commissioner Adams reported that the San Juan Fair was a great success and thanked Anna Thayn and her staff for their excellent work. The concert featuring Josh Turner was a sellout with standing room only. The Junior Rodeo and cowboy games were also a great addition to the fair and very well received. It was suggested that we should continue with the Junior Rodeo, cowboy games program and associated events rather than hiring a professional rodeo company and encourage the local community and the Native American community to participate. Commissioner Adams complimented Rick Bailey , SJC Emergency Management Director, on his invaluable contribution and leadership to the County in the management of the Navajo Mountain water crisis. Rick was already addressing the problem when Commissioner Adams called to notify him of the emergency. He commended him on all his efforts, especially on going the extra mile lending his help in digging out the water tank. Commissioner Manuel Morgan attended the Navajo Conference on Health Care last week. Commissioner Adams will attend the AOG on Thursday at 1:00 p.m. as Commissioner Morgan will be out of town this week. 11:50 a.m. Commissioner Bruce Adams made a motion to go into Executive Session to discuss contracts and personnel issues.
