SAN JUAN COUNTY COMMISSION MEETING February 20, 2007 The regular meeting of the San Juan County Commission was held on February 20, 2007 at 9:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk /Auditor Dianne F. Neuss, SJC Deputy Clerk Commissioner Kenneth Maryboy made a motion to approve the minutes of February 12, 2007 with corrections noted. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Evan Lowry - Planning Department Evan received a phone call and an e-mail from Lou Brown of SITLA requesting a letter from the County in support of better management of campsites, roads and maintenance in the Kane Creek area. Kane Creek is located in both Grand and San Juan Counties. This is a very heavily used area with many tourists from Moab driving and camping in the area. Evan said that it is in great need of improvement and management due to the heavy use and flood damage. Commission members agreed that this is an area of concern and needs attention. Commissioner Lynn Stevens made a motion to support the State's efforts to improve the Kane Creek area and respond with a letter of support. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Evan will prepare the draft for Commissioner's review and signature. Evan discussed the work on the road between 191 and the Loop Road with Bryan Torgenson of SITLA. The road is in Spanish Valley near Pack Creek and Ken's Lake. David Bronson did the GPS work on the road after the State did the survey. There is agreement with the legal description except that the roads are located in San Juan County not Grand County. Evan said the Archeological study is in the works. Evan will draft a letter to Bryan in support of the work being done there. Charles Kay will begin his work taking additional photographs of the winter and summer ranges for deer. Evan also noted that Earl Hindley, Photographer, recently took photos at Arch Canyon for comparison if anyone is interested in seeing them. Sheriff Mike Lacy - SJC Sheriff's Department Sheriff Lacy presented a contract between the State and County for approval and signature. The contract is an agreement with the State for the County to take over sex offender counseling in the San Juan County correctional facility. Derek Bethea will be hired to fill this full time position. Sheriff Lacy said that he has been in contact with Senator Dmitrich to try and obtain additional funding for the Counseling Program. Commissioner Lynn Stevens made a motion to approve and sign the contract between the County and the State to provide sex offender counseling at the San Juan County Correctional Facility. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Sheriff Lacy requested approval for the purchase of a new printer for the dispatch area in his office. He presented two bids from Tiger Direct and from CDWG. It was recommended that the printer be purchased from the low bidder, Tiger Direct, at a cost of $539.00. Commissioner Lynn Stevens made a motion to approve the purchase of a new printer for the dispatch office from Tiger Direct in the amount of $539.00. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. The increase in reimbursement from the State for inmates was discussed as well as the prospects for expansion of our correction facility. Sheriff Lacy said that he has been looking at plans to expand the facility and noted that, at present, there are 106 inmates housed in San Juan County jail which has the capacity to house only 96 inmates. He said that although females are also housed in the same facility, it is not really set up to accommodate females. He said that the cost of expansion would have to be determined and we would have to work with the State to determine the number of inmates we could house. Commissioner Adams asked if the Sheriff's office utilizes the law enforcement safety training programs provided by UCIP. Sheriff Lacy said it is difficult to send employees out of the area for training. Commissioner Adams will look into this issue when he attends the next UCIP Board Meeting. Since they do require employees to have defensive driving training, it was suggested that they come to San Juan County to provide the training. Rick Bailey said that they were set up to bring simulators to the various counties for training but discontinued it before coming to our County. Charles DeLorme - SJC Economic Development Charles requested approval to purchase a digital projector. He said that Frank Morrell has been researching the procurement for him and got two bids one from Tiger Direct in the amount of $885.00 and the other from NEWEGG.com for the same amount. It was recommended that the purchase be made from Tiger Direct based on previous experience. Commissioner Lynn Stevens made a motion to approve the purchase of a digital projector from Tiger Direct in the amount of $885.00. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. Charles updated the Commissioners on the prospect of partnering with National Geographic to produce a branded Geotourism Map. The approximate cost could be from $55,000 to $150,000. Once the County is affiliated with National Geographic the likelihood of their providing tours in the area will increase. Charles said that Leigh Von DerEsch, Director of Utah Office of Tourism, will likely support the project Cyndi Eldredge - Personnel Office Cyndi presented a recommendation to hire Anita Hathale as the Senior Aide at the Blanding Senior Center. This is a part time position Grade 1, Step 1. Commissioner Lynn Stevens made a motion to approve the recommendation to hire Anita Hathale for the Senior Center Aide position at the Blanding Senior Center. Commissioner Kenneth Maryboy seconded the motion and Commissioner Bruce Adams declared the motion carried by unanimous vote. Cyndi reported that there are two position openings, one for a Victims Advocate replacing Cynthia Black, who recently resigned, and another position in the Sheriff's office for a Dispatcher. Cyndi explained that Preston Palmer resigned his position in the correction's facility and Jeremy Homedew was advanced leaving the dispatcher position open. Cyndi said she received three applications for the Victims Advocate position and will begin interviewing for the position. Cyndi, as Risk Manager, noted that there has been no lost time due to work related injuries in the County for the last fourteen months. Everyone agreed that this is an excellent record for County employees. She said that the insurance company requires that the County institute and incentive program for employees encouraging safety in the workplace. She located a program which would allow each County employee to receive a gift of their choice in the amount of $23.00 from a catalog provided. The gift would be shipped free of charge. The total amount for this program which includes all County employees will amount to a little more than $3,000. The County will receive a refund of $10,000 from UCIP which could be used for this purpose. Cyndi also said that the insurance company suggested that we post signs showing the Counties performance in keeping workers' compensation claims to a minimum and that we publish a press release in the local newspapers. Cyndi will write the article for the press release for Rick's approval. Commissioner Kenneth Maryboy made a motion to approve the incentive program, a $23.00 gift for each County employee as recommended. Commissioner Lynn Stevens seconded the motion and Commissioner Bruce Adams declared the motion carried by unanimous vote. Lester Nixon, Executive Director of UCIP, has requested that the County appoint an Insurance Coordinator. Cyndi will serve as the Insurance Coordinator along with her other duties as Risk Manager and Safety Officer and provided the "Notice of Appointment" for Commission signature. Commissioner Lynn Stevens made a motion to appointment Cyndi Eldredge as the Insurance Coordinator. Commissioner Kenneth Maryboy seconded the motion and Commissioner Bruce Adams declared the motion carried by unanimous vote. Cyndi reported that Mr. Nixon will be the speaker at the World Risk Management Conference in Boston which will be held from June 10th to 13th of 2007. The registration for the Conference is due in at the end of the month. Cyndi said that she applied for a scholarship in the amount of $1,000 to offset the cost of the trip. The entire cost will be considerably more than $1,000. After she receives notice regarding the scholarship, she will submit an Out-of-State travel request to the Commission. Commissioner Bruce Adams will also attend the Conference. Cyndi reported that she was asked to be a guest speaker at a Statewide Risk Management meeting. Commissioner Bruce Adams - Healthcare Service Board Appointment Commissioner Adams said that Allen Berry applied to be on the Healthcare Service Board and would be taking Sarah Neumeyer's place who recently resigned from the Board. Today is the deadline for application to the Board. Commissioner Lynn Stevens made a motion to approve the appointment of Allen Barry for the Healthcare Service Board. He will take over Sarah Neumeyer's term. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioners discussed the specifics regarding term lengths and bylaws of Board membership for the Healthcare Service Board and the importance of making sure that it is noted when someone is elected to replace another member. Norman L. Johnson - SJC Clerk/Auditor Norman presented a beer license for approval and signature. The license is for the new owners of the Cottonwood Steak House in Bluff. A license was approved and paid for by the previous owners but a new license needs to be issued to Richard Reeb and Diana Davidson who now own the business. Norman noted that the new owners are bonded and they will work out the cost of the license between themselves. Commissioner Kenneth Maryboy made a motion to approve the beer license for Richard Reeb and Diana Davidson, the new owners of the Cottonwood Steak House. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Norman distributed a list of Commission Assignments for the Commission review. If there are any changes, please let him know. We will try and keep the list updated. A State Tax Commission Hearing will be held on April 24th to address two petitions received, one from Michael Peed and another from Charles and Lucy Nelson appealing their tax. The Hearing will be at 1:00 p.m. and 2:00 p.m., and representatives from the Utah Tax Commission will attend the meeting along with Howard Randall, SJC Assessor and Norman Johnson, Clerk/Auditor. Rick Bailey - SJC Administrator Rick presented three building permits for approval. Darrell L. Benson - 47 No. Hang Dog Road, Old LaSal - Log Home Residence Eagle Air Med - 212 West Freedom Way, Blanding - Remodel of Existing Building Cody Schriver - 44 West Coronado St., Spanish Valley - Shop Commissioner Lynn Stevens made a motion to approve the building permits providing all the appropriate signatures are in place. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Rick requested approval for three cattleguards purchased by the Lisbon Valley Mining Company to be installed by the County Road Department. The cattleguards are paid for by the company and will be installed and maintained by the Road Department. One cattleguard will be installed on Little Valley Road and two on County Road #313. Commissioner Lynn Stevens made a motion to approve the installation of cattleguards at the two locations, County Rd. #313 and Little Valley Road. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motioned carried by unanimous vote. Rick was asked by the City of Blanding if the County plans an increase in sales tax. They are making this inquiry because they cannot raise their sales tax if the County has plans to raise its tax rate. Rick will let them know that the County has no plan to increase sales tax. Rick said that he is preparing a letter to UDOT regarding the plans for the three million dollars left over from the recent Hwy. 491 project. Rick plans to be in the office the rest of this week. Open Time and Other Business Liz Thomas, of Moab, came in to bring two concerns to the attention of the Commission. The first request is that the Commission ask people addressing the Commission to state their name for the record. Liz said that this is not always done. Commissioner Bruce Adams apologized for neglecting this important item and in the future people will be asked to state their name for the record when addressing the Commission. The second issue of concern is the Agenda which is posted in the building and published on the County website. Because the Agenda is not always specific as to the issues being addressed, it becomes a problem, especially when an issue of interest to an individual is not on the Agenda and is then acted upon by a vote. If an item is not specified clearly on the Agenda as an action item that may or may not be voted upon, there is no opportunity for a member of the public to voice their opinion on the issue. Commissioner Adams suggested that the items listed on the Agenda could be screened through the Clerk's office so that the Agenda lists more specifically the issues and actions that will be addressed. It was noted that, at times, there are last-minute issues that come up that do not appear on the Agenda. Commissioner's Reports Commissioner Lynn Stevens reported that he attended a Statewide Bureau of Land Management Meeting but was not able to attend the UAC Forum because it took place on the same day. He also attended approximately six legislative committee meetings on various subjects including SITLA road procedures, retroactive State funding for Kane County litigation, (strongly opposed, SJC also incurs litigation costs paid for from the County budget) and the Tax Stability Trust Fund Account issue. Commissioner Stevens plans to go to SLC on Thursday. He noted that he will attend a meeting in Senator Bennett's office with County Commissioners at 10:00 a.m. on Friday in room #4112. This meeting will address State and Federal assistance in land use plans for counties. Commissioner Maryboy discussed the difficulties at the Red Mesa High School and noted that the school is in the Arizona School System. He met with the Attorney General of the Navajo Nation and discussed a building to house the workforce services in Montezuma Creek and also discussed a problem that occurred when a Seismograph worker was asked to leave an area because his company did not have permission to do testing there. He plans to meet with the new Vice President of the Aneth Chapter at 6:00 p.m. this evening and attend a Ute Meeting to discuss housing today in White Mesa. He will travel to SLC and continue to meet with members of the legislature there and attend the UAC meeting on Thursday and the Cowboy Caucus. Commissioner Bruce Adams attended the Weed Board meeting, CWMA, and was very impressed with the Board and the good work they are doing addressing weed problems. He attended the Geotorism Meeting with Charles DeLorme, Commissioners Stevens and Maryboy. He noted that UAC is in support of Senate Bill #13, the Renewable Tax bill giving tax credit for renewable energy. He attended the UCIP Board Meeting and also attended the Navajo Mountain Chapter meeting on Sunday. Chapter members expressed their appreciation to the County for help with their recent water issues and requested help with road work and with funding for a multipurpose building there. Commissioner Adams will be in SLC for the rest of the week. Commissioner Stevens suggested that the Commission address the establishment of the County Planning and Zoning Commission at next week's Commission Meeting. This item will be placed on the Agenda and a public hearing will be planned then. Commissioner Kenneth Maryboy made a motion to adjourn the meeting. Commissioner Lynn Stevens seconded the motion.
