SAN JUAN COUNTY COMMISSION MEETING March 26, 2007 The regular meeting of the San Juan County Commission was held on March 26, 2007 at 9:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Commission Chair Lynn Stevens, Commissioner Kenneth Maryboy, Commission Vice Chair Tammy Gallegos, SJC Administrative Assistant Norman Johnson, SJC Clerk-Auditor Dianne F. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Evan Lowry - SJC Planning Office Evan presented the letter he drafted to the BLM advising them of our desire to be involved in the cooperative decision making process for the Resource Management Plan. Commission Chair, Bruce Adams will sign the letter. Evan said he met last Wednesday with members of the Monticello and Moab BLM office to discuss the Plan and his concerns. Commissioner Stevens said that the BLM will consider input and/or evaluation and updating of the Plan from April 16th to the 27th. Evan as well as Commissioner Adams attended the Forest Service Open House. Evan said that two issues were discussed in the EIS. One was the Forest Service working to address the water shed area of the mountain and the completed water shed project for Monticello and Blanding. The second issue discussed was the beatle infestation and the three alternatives to address the problem. If it is determined that the problem should be treated, there will have to be adjustments to the road because of the tight switchbacks. Cyndi Eldredge - SJC Human Resources Department Sheriff Mike Lacy requested Commissioner approval to promote Kenneth Black from Jailer to Corporal, Step 122 to Step 133 with the associated increase in compensation. Lynn Laws, Road Superintendent, requested Commission approval to promote Scott Christensen to a Heavy Equipment Operator, Step 93 to Step 117 with the associated increase in compensation. His second request was to promote Trint Barry from Laborer to Light Equipment Operator, Step 37 to Step 48 with the associated increase in compensation and the third request is to change Jonathan Nielson's status from Temporary employee to Permanent Full-Time employee with benefits. Commissioner Lynn Stevens made a motion to approve promotions for Kenneth Black of the Sheriff's Department, and for Trint Barry and Scott Christensen, Road Department Employees and the status change from Temporary to Full Time, with benefits for Jonathan Nielson, also a Road Department Employee. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Cyndi discussed her intention to advertise for one or two temporary weed sprayers in April so that they can begin work by May 1st. She also advised the Commission that the quarterly Safety Committee Meeting will be held on Thursday at 2:00 p.m. This meeting is to discuss safety and review any incidents that have occurred. Cyndi said that Commissioner Maryboy asked her to investigate providing a benefit to help pay for orthodontia coverage for County employees. The BlueCross BlueShield coverage provides $1,000 of coverage ($500 per year for two years). As the County is self insured, it would likely cost at least 12 to $15,000 the first year. Cyndi recommended that if the County decides to provide this coverage, it should implement the coverage at the beginning of 2008 so that employees can be informed prior to the change. Commissioner Stevens suggested that an employee survey be conducted to ascertain the employees interest in this benefit. Cyndi will send out a survey and report back to the Commission. Cyndi reminded the Commission that the mandatory Harassment Training for all employees of the County will take place tomorrow at 10:00 a.m. and again at 2:00 p.m. It will be held for Road Department employees at 8:00 a.m. on Wednesday in Blanding. Cyndi plans to present each employee with a safety award for their efforts in preventing work related accidents. Lou Muller and Sylvia Stubbs - Utah Extension Lou Muller and Sylvia Stubbs presented information regarding the upcoming schedule of events for the Family and Children Conference which will be held in Blanding from April 9th through the 13th. Lou distributed a copy of the poster for the Conference. Commissioner Adams asked questions related to the scope of the event and how it has been promoted and marketed throughout the various areas of the County. Lou said that they had a late start this year in organizing the event and obtaining funding and they are just starting to get the program off the ground. She said that Charles DeLorme, SJC Economic Development, has been very helpful and provided funding for marketing. She reviewed the plans and steps that have been taken so far to advertise and promote the Conference. Next year Lou plans to visit all the Native American Chapters to promote the Conference and visit other areas in the outlining areas of the Counties to promote the event. This year, in addition to posters for the event which will be distributed and posted in all areas of the County, there will be announcements made on several radio stations around the County, which will be aired closer to the event as well as advertising the event and schedule in the local newspapers. Activities include a Kite Flying Festival, Health Fair, when Linda Larsen will conduct an Ambulance Tour and a presentation on "What To Do After Calling 911", a presentation entitled "Speaking of Families" by Gary Torres, a talk on "Strengthening Family Ties" given by Dr. Tom Lee, USU Extension and a presentation by Dr. Brian Higginbotham, USU Extension, entitled "Parenting and Enjoying it!". Various workshops relating to families and children will also take place throughout the week. Lou presented a "Proclamation" for Commission approval, adoption and signature. The Proclamation is entitled "A Proclamation to Designate April as the Month of Family and Children in San Juan County. If the Commission adopts the Proclamation, it will allow for many more events to take place throughout the entire month of April. Commissioner Adams noted that Lisbon Valley Copper Mine, Resolute Corp and others have expressed their willingness to participate and sponsor Community wide events and projects and suggested that Lou contact them. He also suggested that San Juan Mental Health be included in the program. The Commission agreed that this would be a good thing for the County. The Proclamation is as follows: PROCLAMATION TO DESIGNATE APRIL AS THE MONTH OF FAMILY AND CHILDREN IN SAN JUAN COUNTY WHEREAS, families and children face critical challenges in today's society; and WHEREAS, according to U.S. Census numbers, San Juan County has 3,234 families; and WHEREAS, parents are raising children who will be the leaders of tomorrow; and WHEREAS, parents benefit from programs that teach universal values, family and parenting skills, nutrition, and healthy life practices; and WHEREAS, Utah State University Cooperative Extension, in partnership with the College of Eastern Utah - San Juan Campus, Blue Mountain Panorama, and Utah Navajo Health System, Inc., will present the 2nd Annual Family and children Conference at CEU-San Juan Campus on April 9-13; and WHEREAS, the Family and Children Conference will continue to be presented as an annual event in the month of April for the purpose of celebrating and strengthening families; and WHEREAS, strong families build strong communities; NOW, THEREFORE, WE the County Commissioners of San Juan County, in recognition of families and children, do hereby proclaim April as the Month of Family and children in San Juan County, and encourage agencies, organizations and groups to hold family events, activities, and programs each year during the month of April. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. The Commission recognized Sylvia Stubbs and thanked her for her generosity in donating her time and efforts in the area of family education as well as with other projects for the County. Commissioner Lynn Stevens will attend the Forum and Luncheon on April 12th at 1:30 to announce the "Proclamation". In addition, "The Dreamcatcher" award winner will be announced at that time. Commissioner Adams and/or Commissioner Maryboy will plan to attend the Friday evening event at 7:00 p.m. to announce the "Proclamation" then. Howard Randall - SJC Assessor's Office Howard said that three more business owners applied for the business personal property tax exemption. Commissioner Stevens reviewed the process with Howard. Howard explained that Commission approval of the list of applicants still allows his department to access the validity of the information provided and request further documentation or preform an audit. If the information provided is incorrect, a fine can also be assessed. Commissioner Lynn Stevens made a motion to approve the list of petitioners for the business personal property tax credit with the understanding that, if the Assessor has any questions regarding the applications, he will take steps to make adjustments. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Matt Strong - State of Utah and SJC Fire Warden Matt said that Brenda Dale, of the Forest Service, could not attend today's meeting as planned. Matt came in her place to update the Commission on the status of the Fire Plans for the various areas in the County. He discussed the County adopting House Bill #146 which details guidelines to incorporate into the County subdivision regulations and for private property owners. He advised the Commission that fire plans need to be considered when subdivisions are being planned. The regulations relate to roads, fuel supplies on property, recommended distances in proximity to the residence, and access to water. He said that private property owners cannot be forced to follow the recommendations but the consequence is that if fire fighters encounter obstacles because regulations have not been met, it may prevent them from going in the fight a fire. The other issue is that the County will not be eligible for Wildlife Fire Funds if they do not adopt House Bill #146. Mike will work with Trent Shafer, Monticello City Manager, to work on forming a committee to write a Fire Plan for Monticello. The Forest Service also needs to be brought into the fire plans for Monticello. Trent will talk to Evan or Ben. Matt has been working on Fire Plans for other areas of the County; Bluff, La Sal, Blanding and Eastland. Contact should also be made with the BIA to address issues on BIA land. Commissioner Maryboy will work with Matt on setting up a meeting. Commissioner Stevens said that some of the imposed restrictions in House Bill #146 are not reasonable and that the Bill needs to be revisited. Norman Johnson - SJC Clerk/Auditor Norman requested Commission approval and signature for the renewal of a Beer License for the Cow Canyon Trading Post owned by Susan Doran. Commissioner Kenneth Maryboy made a motion to approve renewing the Beer License for the Cow Canyon Trading Post. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Norman requested approval for Out-of-State travel to attend the NACRC for County Clerks in Richmond, Virginia in July of 2007. The cost of the trip will be approximately $1,600 including air and hotel. This travel expense is included in the election budget. Commissioner Lynn Stevens made a motion to approve the Out-of-State travel for Norman Johnson to attend the NACRC Meeting in Richmond, Virginia. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Tammy Gallegos - SJC Administrative Assistant Tammy presented two building permits for approval and signature. Philip J. Scruton - County Road #318, Summit Point - Residence Carmen & Amber Beshoner - Lot 15 Beeman Road, LaSal - Manufactured Home Commissioner Lynn Stevens made a motion to approve the building permits provided all appropriate signatures are attached. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Tammy reported that the State Parks Service is working with Tri-Hurst Construction Company to cut the cables on the Bluff Swinging Bridge to get them out of the way. Charles DeLorme will work on getting the restoration project for the bridge started after this is completed. Tammy requested approval to purchase laptop computers for the Sheriff's Department vehicles to go along with the radios previously purchased. She said that the remainder of the Home Land Security funding ($23,000) needs to be used by the end of the month. Commissioner Lynn Stevens made a motion to approve the expenditure for the laptop computers for emergency vehicles. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried. Tammy presented two procurement requests for Commission approval for the Road Department. Three bids were obtained for a 6 ½ Bench Vise with the low bid submitted by The Tool Warehouse in the amount of $389.00. The second request is for a Combination Unit - Air line filter, regulator and lubricator. Three bids were obtained with the low bid from Granger at $341.75 for the unit. Commissioner Lynn Stevens made a motion to approve the purchase of the Bench Vise and Combination Unit - Air line filter, regulator and lubricator. Commissioner Maryboy seconded the motion and Commissioner Bruce Adams declared the motion carried by unanimous vote. Tammy presented the Four Year Aging Plan for Commission Signature. The Plan was approved by the Aging Advisory Council. Commissioner Kenneth Maryboy made a motion to approve signing the Four Year Aging Plan. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Sheriff Lacy - Sheriff's Department Sheriff Lacy requested approval to purchase a new Steamer for the jail kitchen. The one they have been using broke down. This is an unexpected expense of a little over $14,000 but it needs to be replaced because it is an item that is used everyday. Two bids were received with the a difference of $75.00. Sheriff Lacy discussed funding for the purchase including existing budget and money from the Inmate Trust Fund Account. Commissioner Lynn Stevens made a motion to approve the purchase of Steamer. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Sheriff Lacy requested approval for two other procurements. The first is a request and recommendation to purchase two hand guns with night vision from Glock Company for $494 each, a total of $988 and the other request is to purchase two shotguns. Two bids were received for the shotguns with the low bid from Jerry Sports for $1,539.94. The Sheriff recommended that the purchase be made from Jerry Sports. Commissioner Lynn Stevens made a motion to approve the recommended procurements for two hand guns and two shotguns for the Sheriff's Department. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Sheriff's Lacy reported that he received a request from the Ute Tribe Manager in White Mesa to take over law enforcement in that area. The Tribe will pay for two deputies to be assigned to the area. They are going to be contacting the Commission to set up a meeting regarding this issue. Sheriff Lacy discussed expansion plans for the jail and for court rooms and noted that the State Legislature increased the compensation for prisoners. They will still focus on housing and counseling sex offenders here in the SJC Jail and Sheriff Lacy said prisoners can take advantage of educational opportunities provided to obtain a degree while incarcerated. Brenda Harvey - Southern Fair Brenda came to verify the status of her managing the Southern Fair as was discussed following last year's event. Commissioner Kenneth Maryboy said that a Navajo Utah Commission will meet in a couple of weeks and will appoint board members and a manager for the Southern Fair and make other decisions regarding the fair. He said that they would like to involve local members of the community rather than contracting with an outside rodeo company. Additionally, he is lobbying for additional funding to help with the cost of the fair. Brenda said that she was under the impression that she was going to manage the fair and that she has been working on it for several months. The Commission recommended that her time and expenses should be taken into consideration. Commissioner Maryboy agreed. He commended Brenda on her efforts and complimented her on her management skills. Brenda asked that he get back to her by Wednesday so that she will have time to cancel meetings that have already been arranged if needed. Susan Taylor, of the SJC Economic Development Department, said that Charles asked her to let Commissioners know that marketing funds are available for the Southern Fair. The County contributed $30,000 for the fair last year, in addition to income of $4,400. Commissioner Stevens especially thanked Brenda for her efforts. Appointment of Board Members for the SJC Planning and Zoning Commission Commissioner Adams opened the floor to comments regarding on the appointment of board members to the newly established SJC Planning and Zoning Commission which will be decided at today's meeting. Marcia Hadenfeldt said that, although her background is detailed in the application she submitted, she wanted to say that she has experience in this area and that it is a focus and interest for her. No other comments were made regarding this issue. Appointment will be made later in the meeting today. Open Time and Other Business Susan Taylor reported that the Utah Office of Tourism will visit our County and that she attributes the visit to Charles' efforts to promote San Juan County tourism. They will be here for a half a day on Wednesday and Thursday and Friday all day. Charles and Susan will accompany the group to the various areas of interest in the County. If Commissioners would like to meet with members, Susan will be happy to arrange a meeting. Phil Glaze, from Wilson Arch, came to voice his concerns regarding the turnouts and parking areas near Wilson Arch. He said that he has contacted UDOT on many occasions about the trash and overnight truckers but has had no response. He made a request that the County try and intercede with UDOT on this issue. He has proposed that it be shut down or improved. He said that many of the trees have been killed in this area and picking up trash is a full time job. This is a problem for homeowners who would like maintain the aesthetics around their homes. He noted that there is trash along the highway as well and that if we are interested in attracting tourism the problem needs to be addressed Commissioner Adams responded saying that he appreciates Phil's concern and that it is well known that he is a great ambassador for the County. Commissioner Stevens said that he will talk to John Nord when he meets with him tomorrow evening. He also said that this is a health issue. Commissioner Maryboy said that there is a problem with trash bags left along side of the road not being picked up and that he will draft a letter to UDOT from the Chapters. The County will also write a letter to UDOT and to the Health Department. Commissioner's thanked Phil for coming in today. Mr. Glaze was asked about the turn lanes into his property and the commitment to place them. He indicated they would be placed after the current UDOT road project in the area is completed. Fritz Pipkin thanked the Commission for authorizing opening the road over the mountain. He also reported that members of the VMTE appreciated the letters of support from the County and that he will be in Washington on the from April 21st to the 25th to address the Congressional Delegation. Commissioner Stevens will talk to Dr. Sundwall and make sure that he is in the loop in support of the VMTE's efforts and obtain a letter from the Governor as well. Fritz thanked everyone for their help. Mike Adams asked the Commission to follow up on the creation of a Special Sewer and Water District for the Ranches at Elk Meadows. He spoke to Assistant Attorney Walter Bird and followed his instructions to comply with the Code relating to the creation of a Special Service District. He has the required signed Petition and presented it to the Commission and asked for the Commission's approval and facilitate the process by placing a public notice for two weeks as required, setting a Public Hearing date. They have decided to go ahead and put in an engineered sewer system since some of the lots did not pass the perk test. After approval by the County, the Lieutenant Governor needs to sign off on the establishment of the Service District. Mike was told that this would take 10 days. The earliest that the Public Hearing could take place would be on April 16th. Mike also said that since they are going to put in a engineered sewer system, he does not think it is necessary to do perk tests on newly created lots but he is not sure if Rick Meyers will sign off on the plats without perk tests. The Commission will try to follow up with Rick on this issue. Tammy was asked to place the notice in the newpapers for the Public Hearing on April 16, 2007. Commissioner Lynn Stevens made a motion to approve the advertising for a Public Hearing to create a Special Service District for Sewer and Water for The Ranches at Elk Meadows. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams abstained from the vote. Commissioner Maryboy declared the motion carried. John Ogden, Manager for the Flat Iron Mesa Partnership, came in today to ask for help from the Commission to try and help to get the process of Plat approval on track for the subdivision. He said that three weeks ago he submitted three Plats to the County office to be approved but has not had any feedback as yet. He discussed tax ramifications as well the fact that he has lost some lot sales because of the time it takes for the approval process to be completed. Commissioner Adams noted that the County needs someone to take responsibility for the process and told Mr. Ogden that his problem will be addressed and try to resolve the issue as soon as possible. Mr. Ogden thanked the Commission for their help. Bob Bushart, a resident of Bluff, reported that the Bluff Water Works did not publish their minutes from the last meeting. 11:45 a.m. - Commissioner Lynn Stevens made a motion to go into Executive Session to discuss personnel matters. Commissioner's Reports Commissioner Maryboy reported that he talked with some members of the community regarding roads on bus routes that need repair and grading. He was also asked to find out about obtaining trash bags for the Aneth Chapter for clean up along the roads. He will address these issues at the next Road Meeting on Monday at 8:00 a.m. He plans to meet with community members regarding hunting issues this evening at 6:00 p.m. Commissioner Adams suggested that he may want to contact someone from the DWR. Commissioner Lynn Stevens attended the UAC Meeting of the Natural Resources Oversight Committee last week. He also met with Selma Sierra, members of Senator Bennett's office and UAC personnel to discuss updating the RMP and additional alternatives. He attended the Governor's Economic Summit on Wednesday where investment bankers and entrepreneurs discussed how to increase raising economic development in Utah. He said that Utah's overall growth is above the National average. He met with the Lieutenant Governor and others regarding the Native American Summit. Three work groups have been formed to make presentations at the Summit relating to Education, Public Health and Economic Development. Andrew Tso was at the meeting and is the Navajo National Representative. President Shirley is scheduled to be one of the speakers at the Summit. Commissioner Adams attended the Forest Service Open House last Tuesday and agreed to take care of road funding issue. He attended the Blue Mountain Area Water Meeting on Tuesday and met with members of Crownquest Corporation on Wednesday. He plans to be in the area all of this week. He reminded the Commission of the next Road Meeting at 8:00 a.m. on Monday morning and of the Revitalization Meeting on that day at 1:30 p.m. in Blanding.
