SAN JUAN COUNTY COMMISSION MEETING April 9, 2007 The regular meeting of the San Juan County Commission was held on April 2, 2007 At 10:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Tammy Gallegos, SJC Administrative Assistant Norman Johnson, SJC Clerk /Auditor Dianne F. Neuss, SJC Deputy Clerk Attendees: Cleal Bradford Evan Lowry Krisanne Bender Charles DeLorme Maxine Deeter Walter Bird Neil Joslin Lynn Laws Erline Frost David Bronson Marilyn Boynton Howard Randall Phil Glaze Commissioner Lynn Stevens made a motion to approve the minutes of April 2, 2007 with corrections. Commissioner Bruce Adams seconded the motion. Commissioner Adams declared the motion carried by unanimous vote. Commissioner Kenneth Maryboy was absent for the vote but was given permission to review and amend the minutes. Evan Lowry - SJC Planning Office Evan presented a letter for approval and signature to Sandy Meyers of the Monticello, BLM. The letter is in support of the Environmental Assessment of Arch Canyon. The letter stipulates that the County has no objection to Jeep use on the road. The Jeep Jamboree event will take place on May 20th and 21st at Arch Canyon and Hotel Rock. Sheriff Lacy will plan on having a deputy at each location and the BLM will also be on the site to make sure that participants stay on the roads. Commissioner Stevens made a motion to approve and authorize Bruce Adams, Chair, to sign the letter of support of the Environmental Assessment of Arch Canyon Commissioner Bruce Adams seconded the motion. Commissioner Adams declared the motion carried by unanimous vote. Commissioner Maryboy was absent for the vote. Evan is working with the BLM regarding designation of wilderness areas. The Monticello and Moab BLM will meet the week of April 16th to review the areas designated as having wilderness characteristics and determine areas that do not qualify. Evan said that they have all the information that we have and noted that the evaluation was done 100% in the BLM office without any field review. Commissioner Stevens said that the State Director of the BLM met with County Commissioners in Richfield. There will be a 90-day comment period when the draft RMP is completed. Cleal Bradford - Four Corners Heritage Council Cleal provided a copy of information related to the status of grants and projects for 2007 which include a grant request for Corridor Management for Trail of the Ancients from the National Scenic Byways Program(map of area provided), Reconstruction of the Co-op Store at the Bluff Fort Visitor /Interpretive Center from the Utah Transportation Enhancement Fund, and the Monument Valley Walkway/Trail also from Utah Transportation Enhancement Fund for 2008. He provided a copy of the Agenda for the next meeting related to the Monument Valley Welcome Center - Vendor Village on April 24th and information about the Hole in the Rock Foundation's efforts along with the County's to mark and preserve the historic pioneer section of the trail from San Juan Hill to Bluff. The BLM has asked for a letter from the County regarding the plan to mark and preserve the Hole in the Rock trail. Tammy Gallegos will work with Cleal to draft a letter to present for approval and signature at next weeks Commission meeting. Again it was emphasized that the Commission is against motorized vehicles of any kind on the on the San Juan Hill section of the historic trail. A letter was presented for Commission Approval and signature to Senator Orrin Hatch in support of a bill for designation of a National Heritage Area within San Juan County, Utah, asking for a Bill to be introduced as soon as the appropriate language can be determined and the process allows. Commissioner Lynn Stevens made a motion to approve and authorize Commissioner Bruce Adams to sign the letter to Senator Hatch in support of the designation of a National Heritage Area. Commissioner Maryboy seconded the motion. Commissioner Adams declared the motion carried by unanimous vote. Charles DeLorme will not be available to attend the "All Hands Meeting" to discuss the Monument Valley Welcome Center on April 24th and asked if a Commission member could attend and, if possible, Rick Bailey. Commissioner Stevens said that he would attend the meeting. Commissioner Maryboy will attend if his schedule allows. Other attendees are from the Navajo Nation, Oljato Chapter, Arizona DOT, Utah DOT, Utah Navajo Trust Fund, Utah Travel Council, San Juan County, MEDA, FCEC, DFCM and Four Corners Heritage Council representatives. Charles DeLorme - SJC Economic Development Charles distributed a list of recent projects that he and the members of his department have been working on in the last few months. Some of the areas of focus are website enhancement, a radio underwriting campaign and trade show exposure. These efforts have resulted in a twofold increase in requests for San Juan County information amounting to approximately 250 requests per day, up from slightly more than 100 per week. For the first time the Utah Office of Tourism toured San Juan County accompanied by Susan Taylor and Charlie visiting various destinations giving them an idea of what San Juan County has to offer. Charles also reported on his trip to Berlin where he was able to meet with more than thirty international tour operators, airline representatives and members of the press. He and members of his department also participated in travel shows in Cincinnati, Dallas, Sandy, Utah, and Portland, OR. In addition to tourism, Charles reported that he has been working with Commnet Cellular to locate cell towers in Bluff and Aneth and is continuing to work on a site in Monument Valley. Commissioner Maryboy suggested that Charles get in touch with Walter Atene about a site in Monument Valley. Charles said he submitted data related to the Harvesting Energy Summit and U.S.U. members will visit our County on April 16th to complete the survey. They requested to visit one of the anemometer sites. He reported that Utah Parks and Recreation are working with Tri-Hurst Construction Company to begin removal of the Swinging Bridge in Bluff. Funding for the reconstruction of the bridge was discussed and information has been sent to Rick Bailey concerning funding. The upcoming Red Bull Air Race was discussed. Charles said that Rick, Tammy, David, Linda and Grayson did a great job putting together a package relating to planning and coordination of the event to submit to Christiane Bendel, Event Coordinator. He said his office has been asked to assist with transportation, marketing and staging venues. The vendor issue was discussed again along with the possibility of the Monument Valley Welcome Center - Vendor Village being available in some capacity for the event. Anthony Peterman of the Monument Valley Arts and Crafts Council is in charge of the Vendor Village. The event will be staged near the old visitors center location in Monument Valley. The tickets for the event are $25.00 each and can be obtained by accessing the "Red Bull" web-site this week. The event will take place on May 12th and participants and organizers will be in the area from May 5th for test flights and setup. There will be bus service from Kayenta and from Bluff. The Red Bull Company offered $80,000 to pave the runway at Gouldings but it may not be possible to take advantage of the offer in time for the event and would have to be approved by the Navajo Nation's Attorney General. Charles reported that his office entered four advertising projects to the Utah Office of Tourism for their yearly awards. The Utah Office Tourism Conference will be held from May 16th to the 18th in Price, Utah. Norman Johnson - SJC Clerk/Auditor Greg Martin was not able to attend today's meeting and asked Norman to present the Modified Agreement between the various partners supporting the Southeast Utah Welcome Center in Monticello. Greg asked that the Commission approve and sign the agreement in his absence. Commissioner Stevens said that at the end of the year the Commission would consider providing additional funding if needed. Commissioner Lynn Stevens made a motion to approve the Modified Agreement with the changes noted and to authorize Bruce Adams, Chair, to sign the agreement. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Tammy Gallegos - SJC Administrative Assistant Tammy presented three building permits for approval and signature. Kurtis Pugh - 757 East Meadow Lane, Blanding - Remodel/Addition Kevin Carroll - Hwy 191, Spanish Valley - Storage Buildings with Small Offices Ray Kenny - 13 Abbey Road - Spanish Valley - Residence Kevin Carroll and Dale Stapley from UDOT have agreed that the new storage building, if the permit is approved, will not be occupied until the turning lane into the subdivision is completed. Commissioner Lynn Stevens made a motion to approve the building permits provided all appropriate signatures are placed. Commissioner Kenneth Maryboy seconded the motion. Commission Bruce Adams declared the motion carried by unanimous vote. John Hauer has requested a variance for a road going into Kane Creek Canyon Estates. Tammy will advertise the Public Hearing for comments on this issue. The Hearing will be scheduled for the May 7th Commission Meeting. Lynn Laws, David Bronson and Attorney Walter Bird - County Road Issue David Bronson, SJC Surveyor, presented an issue related to a disputed road in the Cottonwood Addition in Bluff. Part of the road is on privately owned land and part of the road is on County property. David provided a map for Commissioners to review. After discussion, it was determined that the road has been opened for public use for at least 10 years and should continue to remain open. Attorney Walter Bird will draft a letter to the property owners informing them that the road should remain open to the public. Open Time and Other Business Sheriff Lacy reported on the Easter Jeep Safari. He said overall things went pretty well but the event that was held at Black Ridge had some serious problems. There were so many vehicles that the road was blocked for approximately three hours. He suggested that signs should be placed and the road should be watered down to cut down on the dust which caused a safety concerns. He also noted that parking in the area needs to be addressed. The event takes place on private property and in fact participants are charged an entry fee. It was suggested that the property owner and event coordinators should be contacted before next year's event to provide better organization and possibly to help with the cost of providing services during the event. Sheriff Lacy said that traffic and dust resulted in several near accidents on Hwy. #191. Sheriff Lacy and Walter will draft a letter to the Red Rock Four Wheelers who coordinate the event. Sheriff Lacy said that in addition to the San Juan County Command Post ten deputies and troupers and search and rescue personnel were used. Next year he plans to have water and a portable toilet in addition to the food provided this year. He said that the event is costly to the Department and he would like to see some reimbursement for the services we provide. He also suggested better coordination with the BLM and Forest Service. Commissioner Maryboy acknowledged the magnitude of the event and the fact that it is getting bigger and bigger every year. He said ATV use needs to be controlled and the need for better coordination with Red Rock Four Wheelers. He noted that the event does provide the County with increased business. The upcoming Jeep Jamboree was discussed and the Sheriff will provide a deputy for Arch Canyon and for Hotel Rock during this event. Marilyn Boynton, a resident of Bluff, brought up the road issue at the Cottonwood Addition and said that even if the County protects the "easement" it will not solve the road problem there. She discussed some details related to the road and private property. Phil Glaze stopped by to get an update on his request for help with the parking areas at Wilson Arch. Tammy said there has been no answer as yet to the letter sent to State officials asking for a meeting concerning the issue. Howard Randall reported that the Elizabeth City University contacted him and will forward their application today requesting tax exempt status. Commissioner's Reports Commissioner Lynn Stevens attended two or three meetings last week including the meeting in Richfield with Senator Hatch. Senator Hatch indicated that he did not think much would be accomplished in Washington regarding public lands because of other more pressing issues. Commissioner Stevens attended a meeting with the Forest Service, BLM and Park Service. He will attend an Outdoor Recreation Task Force Meeting on Friday and will be in SLC on Wednesday where he will attend a meeting related to litigation. Commissioner Stevens will attend the UAC Conference in Logan next week on April 18th, 19th, and 20th. He will be out of town next Monday and unable to attend the Commission Meeting but will be available by phone for a vote if needed. Commissioner Maryboy said that he also attended the meeting with the Coordinator of the International Air Race in Monument Valley. There will be a Red Mesa Chapter meeting this evening. He said that the CIB meeting which was very successful. This week he will attend the IGR meeting in Window Rock on Economic Development. He noted that there has been a great interest and offers of financial help for the restoration of the Bluff Swinging Bridge project. It was suggested that, at this point, someone else should take charge of the project other than Charles. Commissioner Adams plans to attend UAC meetings in Logan next week. He attended the CIB Meeting and said that additional information about the contractual agreement between the County and the San Juan Hospital is needed if Grant funds are obtained to pay off the loan. On April 16th he will meet with the State energy representatives who will be visiting the County. Commissioner Lynn Stevens made a motion to go into Executive Session at 11:12 a.m., to discuss personnel issues and possible litigation. Commissioner Kenneth Maryboy seconded the motion and Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Stevens made a motion to exit the Executive Session at 11:51 a.m. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Stevens moved that the Commission go on record as supporting the County Sheriff's position of not releasing inmate photos as requested by a GRAMA request from KSL-TV. Commissioner Maryboy seconded the motion. Commissioner Adams abstained. The motion was passed by a vote of two in favor with one abstention.
