SAN JUAN COUNTY COMMISSION MEETING April 23, 2007 The regular meeting of the San Juan County Commission was held on April 23, 2007 at 9:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Commission Chair Kenneth Maryboy, Commission Vice Chair Lynn Stevens, Commissioner Norman Johnson, SJC Clerk/Auditor Tammy Gallegos, SJC Administrative Assistant Dianne F. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Lynn Laws - SJC Road Supervisor Lynn asked if the County Road Department can maintain a road if there are utilities located under the road. After discussion, it was determined that it does not matter if there are utilities under the road the County can still maintain the road. It was also determined that building permits are a separate issue not related to road ownership. The issue of the County's Subdivision Ordinance which deals with road maintenance in subdivisions was discussed. If a developer builds roads and they meet County road standards, the County will maintain the roads. If the roads do not meet with County road standards (under 10 lots, graveled, over 10 lots oiled), the developer is responsible for maintaining the roads. Attorney Walter Bird added that it is the responsibility of the developer to disclose this information to the buyer. Lynn presented a request for a Road Variance from Teague Eskelsen for one of her subdivisions in Old LaSal. A Public Hearing will need to be scheduled to receive public comment. Commissioner Lynn Stevens made a motion to hold a Public Hearing regarding the Variance for the subdivision in Old LaSal. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried. Tammy will place the notice for a Public Hearing in the local newspapers. Lynn received a call requesting that the County repair the airport runway at Needles. It was noted the County did some work on the runway approximately 10 years ago, but it was a special circumstance when the State contracted with the County to do the work. Since this is a privately owned airport, the County is not required to maintain the runway. By maintaining the runway the County would become liable in the case of an accident due to runway conditions. Commissioner Lynn Stevens made a motion reiterating the County's policy not to maintain private airport runways. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Lynn recommended that the Road Maintenance Contract be dissolved between Grand County and San Juan County to maintain specific roads in San Juan County. He recommended the possibility of a contract for snow removal only on some roads, but that the SJC Road Department should take over maintenance of the roads. He noted that Pack Creek Road needs major work this year, but in the following years he projects the cost to be much less than it costs to contract the work out. Commissioner Lynn Stevens made a motion that we do not renew the contract at the end of April 2007 with Grand County for maintaining roads. Commissioner Kenneth Maryboy seconded the motion and Commissioner Bruce Adams declared the motion carried by unanimous vote. Cyndi Eldredge - Human Resources Office Cyndi asked Commissioner Adams if he had investigated the airport liability rider that provides coverage for war acts and terrorism offered by UCIP. This would be an additional cost of $15,000. After discussing the issue at a recent UCIP board meeting, Commissioner Adams recommended that we should continue with our current coverage at the rate of $12,000 per year. Cyndi requested approval and signature to purchase a Photo ID Machine for use by the Sheriff's Department as well as by Human Resources to produce ID Cards for County employees. The quote, obtained by Alan Freestone, is from Idville Company in the amount of $3,623.95. The cost of the machine will be paid from the security budget as per Rick Bailey. Commissioner Lynn Stevens made a motion to approve the purchase of the Photo ID machine in the amount of $3,623.95. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Cyndi requested approval to hire Joshua Keyes and Kendric Curtis as Full Time Temporary Weed Sprayers positions. Joshua Keyes, who was previously employed, will be hired in at Step 54 and Kedric Curtis at Step 33. Commissioner Lynn Stevens made a motion to approve hiring Joshua Keyes and Kendric Curtis as Full Time Temporary Weed Sprayers. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Ralph Squires, Land Agent - Baseline Minerals Mr. Squires requested approval to lease 20 plus acres of County property for oil and gas exploration. Some of the land is under the road. Walter Bird, Attorney, said that he does not remember the County leasing land under a road. The Commission asked for two weeks to review the information provided by Mr. Squires. Mr. Squires was asked to contact Walter in a couple of weeks. Tammy Gallegos, SJC Administrative Assistant Tammy requested approval and signature for five building permits. Michael W. Redd - 1012 South 300 West, Blanding - Commercial Shop and Office Jim & Susan Ogle - Lot 12 Wilson Arch Resort - Residence Allen Barry - Ucolo Road - Residence Bryan Adams - 1000 E. Clayhill Drive, Monticello - Residence Moab Communications LLC - Sec 7 TWP 27 South and 23 East - Telecommunications Tower and Building Commissioners questioned whether or not the plans for the Tower were approved by the FAA meeting their guidelines for height and other considerations. Bruce Bunker will call the FAA to check on this issue. Commissioner Lynn Stevens made a motion to approve the five building permits provided all appropriate signatures are placed. The building permit for the Tower is approved pending Bruce Bunkers findings. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Tammy requested approval for an Acceptance of Roads in Turkey Trot Estates, Phase II, for inclusion in the County Road System. They are road #1691, Merriam Court and #1701, Rio Grande Drive. Commissioner Kenneth Maryboy made a motion to accept road #1691 and # 1701 for inclusion in the County Road System. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Tammy requested approval for the Acceptance of Road #1681, Luna Circle, located in Estrella Estates, for inclusion in the County Road System. Commissioner Lynn Stevens made a motion to accept Road #1681 for inclusion in the County Road System. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Tammy presented the contract between the County and Red Bull Corporation providing Fire and Emergency Services during the upcoming Red Bull Air Race for Commission approval and signature. Commissioner Kenneth Maryboy made a motion to approve and sign the contract between the County and Red Bull Corporation providing Fire and Emergency Services during the Air Race event. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Tammy presented an Emergency Declaration for approval and signature. The declaration is needed due to the continuing drought conditions in the County and will allow emergency funds to be made available for farmers and ranchers. The declaration is as follows: EMERGENCY DECLARATION OF SAN JUAN COUNTY, UTAH DECLARATION 2007-01 WHEREAS, the County Commissioners of San Juan County have met in their regular county commission meeting on April 23, 2006 to consider the declaration of an emergency status due to the continuing drought conditions that have created an economic and safety concern for the residents of this County, and WHEREAS, the current conditions due to the drought have made will continue to cause adverse effects to agriculture producers, the tourism industry and for the culinary needs of the residents of San Juan County; and WHEREAS, the forecast for continuing drought in the County is not expected to change in the near future; and WHEREAS, fire restrictions will be put in place as drought conditions worsen; and WHEREAS, the availability for fire fighting resources are expected to be limited due to the conditions throughout the Western part of the United States; and WHEREAS, the financial condition of most agricultural producers in this county has, and will continue, to be poor due to the drought conditions along with declining prices for agricultural products for several years and the fact that the agricultural community provides for a large proportion of the economic value of this county; and WHEREAS, certain areas of the County have had their culinary water systems impacted in previous years due to the impact of the drought and other natural hazards; and WHEREAS, the tourism industry has also suffered several years of declining growth due to drought conditions during the past year, health scares due to issues such as Hantavirus and the lingering effects of September 11, 2002. THEREFORE, the Board of Commissioners of San Juan County does hereby declare a Drought Emergency this 23rd day of April 2007 and hereby formally request the following: 1. That the Utah Congressional Delegation accept this emergency declaration and request that the Department of Interior, including the Bureau of Reclamation provide technical staff assistance for the application of water development grants and especially those grants that are set aside for Native American Tribes, that the Bureau of Land Management, and the Department of Agriculture including the National Forest Service, the Farm Service Agency and Rural Development provide cooperation and assistance in the areas of water development. 2. That the Governor of the State of Utah, Jon Huntsman Jr., accept this emergency declaration for San Juan County, and provide coordination with the members of the Utah Congressional Delegation; and A. Order the different departments and divisions of the State of Utah to marshal the services and powers to provide assistance to the County's residents and businesses, provide direct coordination specifically as follows: 1) Request that the Division of Homeland Security with the Department of Public Safety be named as the lead agency in the operations of the State of Utah Drought Response Plan including coordination with the Federal Emergency Management Agency; and 2) Request that the Division of Homeland Security work with officials and staff of the County in implementing the County's Drought Mitigation Plan and the information of the County's Drought Response Plan, and 3) Request that the Department of Economic Development deploy staff to meet with business owners and operators in the County to assist with the effects of the drought and to assist with grants, low interest loans and other financial assistance; and 4) Request that the Department of Agriculture also deploy staff to assist the agriculture producers of the County, coordinate efforts with Federal agencies in provision of financial assistance and other programs; and 5) Request that the Department of Natural Resources assist with the drought response with assistance of additional fire resources if needed from the Division of Forestry, Fire and State Lands; ease of processing well applications from the Division of Water Rights and any financial assistance for agricultural and culinary wells; and the Division of Wildlife Resources will take appropriate and fair reductions of wildlife numbers from private lands, especially crops and irrigated lands as well as appropriate reductions along with grazing permit holders on state and federal lands; and 6) Request coordination and assistance from the Administration of School and Institutional Trust Lands in working with grazing permit holders for both spring, fall and winter grazing; and 7) Request that the Division of Indian Affairs will deploy staff to work with the Native American Governments to provide additional assistance to the residents of the Navajo Nation and the White Mesa Ute reservation, including assistance and coordination with such agencies as Indian Health Services, Bureau of Indian Affairs and other federal and state government agencies; and 8) Request that the Department of Administrative Services, State and Federal Surplus Property work with San Juan County and give preference in obtaining surplus property that can be used by the County and other governmental agencies in their drought response; and 9) Request that financial resources of the State of Utah be made available to assist this County, other local governmental agencies, and those State Departments and Divisions that will be responding and assisting the County in their drought response efforts. 10) Request continued assistance from the Division of Water Rights and the Division of Water Resources as well as other state departments and divisions in evaluating and constructing the proposed Clay Wash Reservoir. 11) Request that state agencies provide assistance to the San Juan Water Conservancy District and the Grand County Water Conservancy District in evaluating and completing new and existing water projects within their jurisdiction of San Juan County. 3. Request the assistance and coordination of the Bureau of Land Management and the National Forest Service in working with grazing permit holders to allow for maintenance of herds and working with cities and communities in the provision of culinary water systems and projects and provide additional coordination with local fire officials, including the provision of surplus fire apparatus or equipment to meet local needs. 4. Request the Federal Farm Agency Service provide assistance and coordination with farmers and ranchers to provide financial assistance through disaster programs and financial assistance for water wells and other water development project and that other emergency programs be implemented that will provide for additional grazing alternatives, water hauling costs, feed assistance, etc. 5. Request that the Bureau of Reclamation, the Bureau of Indian Affairs, the Navajo Nation and Ute Mountain Tribal governments accept this emergency declaration and provide additional assistance to the residents of their tribal nations, in particular the area of Navajo Mountain in which will likely require overall assistance in maintaining their culinary water system(s) due to previous drought and wildland fire issues. 6. Request that the residents and visitors of the County take extra precautions to prevent any type of fire and specifically the following: A. When specific conditions warrant, ban the issuance of any burning permits until conditions significantly moderate to the point the County Commission may alter the ban. B. Ban any and all fireworks from private lands within the County, not including the incorporated communities of Blanding and Monticello. C. Extra precautions should be taken with open fires. 7. Urge residents of the county to conserve the use of water, especially outside watering. 8. Request emergency road maintenance funds for this situation so that the county road department may maintain county roads and request patience of county residents with road conditions, especially gravel and dirt roads that may become rough and wash boarded until such time that there is sufficient moisture to do proper maintenance. 9. Request assistance from Federal agencies in the continued evaluation and construction of the Clay Wash Reservoir that would provide additional supplies of culinary and agriculture water. 10. Request assistance in providing an overall program to develop agriculture water storage on the Utah portion of the Navajo Nation; i.e., cleaning and repairing existing reservoirs, providing additional reservoirs, common water wells. 11. Appoint Rick M. Bailey, County Administrator and Director of Emergency Services as the County Drought Response Coordinator and contact person during this emergency declaration. Commissioner Bruce Adams asked that the position be advertised as there may be other qualified contractors who are interested and we may want to consider. Commissioner Lynn Stevens made a motion to approve hiring a Contract Plan Writer with the understanding that the County's procedures be followed. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Tammy presented a revised letter to Congressman Jim Matheson asking for his assistance in having the U.S. Department of Energy repair County Road #127. The changes were made at the recommendation of Brandy from The Tomhave Group. Commissioner Lynn Stevens made a motion to approve and sign the revised letter to Congressman Matheson. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. It was also suggested that Brandy may be a great help to the Victims of Mill Tailings Exposure Group with their efforts at the Federal level. Tammy will pass on this information and an appointment will be arranged to meet with Brandy. Approval of Resolution No. 2007-06 Resolution No. 2007-06 was submitted for approval addressing the release of San Juan County Health Care Service District from the approximately five hundred fourteen thousand three hundred dollars and sixty-three cents ($514,300.63) outstanding loan balance still owed to San Juan County, Utah. The Resolution is as follows: RESOLUTION NO. 2007-06 RESOLUTION TO RELEASE THE SAN JUAN COUNTY HEALTH CARE SERVICE DISTRICT FROM THE APPROXIMATELY FIVE HUNDRED FOURTEEN THOUSAND THREE HUNDRED DOLLARS AND SIXTY-THREE CENTS ($514,300.63) OUTSTANDING LOAN BALANCE STILL OWED SAN JUAN COUNTY, UTAH WHEREAS, on August 28, 1999, the San Juan Health Care Service District, signed a promissory note for a loan of Five Hundred Thousand Dollars ($500,000.00) from San Juan County, Utah; WHEREAS, on January 28, 2003, the San Juan Health Care Service District, signed a promissory note for a loan of Five Hundred Sixty-Nine Thousand Seventy-One Dollars and Fifty-Six Cents ($569,771.56) at Two and One-Half Percent (2.5%) for Twenty Five (25) years from San Juan County, Utah; WHEREAS, on March 26, 2007, the San Juan County Commission via a letter to the state Permanent Community Impact Board (CIB), expressed its support for the application for funding submitted by the San Juan County Health Services District and committed to "forgive the $500,000.00 out standing loan which they presently owe, as a gesture of support to their financial challenges" because in their judgement such an action would contribute to the health and safety of county inhabitants; and WHEREAS, on April 5, 2007, the CIB agreed to give the San Juan County Health Services District a grant of One Million Five Thousand Dollars ($1,005,000.00) to purchase new equipment for the San Juan County Hospital. NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY LEGISLATIVE BODY OF SAN JUAN COUNTY, UTAH, that it releases the San Juan County Health Care Services District from its obligation to repay San Juan County a loan with a balance of approximately Five Hundred Fourteen Thousand Three Hundred Dollars and Sixty-Three Cents ($514,300.63) as evidenced by the Release of Promissory Note(s), dated _____________________ and attached hereto. Commissioner Lynn Stevens made a motion to approve the Resolution to Release San Juan County Health Care Service District from the $514,300.63 owed to San Juan County. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Phil Glaze - Wilson Arch & Dale Stapley - UDOT Mr. Glaze and Mr. Stapley came in to discuss issues relating to the Wilson Arch turnout and Phil Glaze's commitment to put turn lanes into his development at Wilson Arch. Phil's concern is that UDOT is not maintaining the parking/view areas at Wilson Arch. He is concerned with the overnight truck parking and the trash in the area. Commissioner Adams discussed these concerns at a recent meeting with Dal Hawks and, since then, trash cans have been delivered to the site. The Commission agreed that it has become somewhat dangerous with people pulling in and out of the area and that there is a need for acceleration and deceleration lanes. He also expressed that the County is in the middle because UDOT is requesting that the County deny building permits until Phil meets his commitment to UDOT. Phil said that he has been trying to get contractors to put in the turning lanes at his development but only had one contractor respond but they cannot begin the job until September. Dale said that the financing of each project is approved individually but agreed to do whatever possible to help get the turnout area in the pipeline for consideration . The fact that trucks park overnight was discussed and a suggestion was made to place a sign at Wilson Arch denoting overnight parking and facilities several miles north on 191. Dale said he would try and see what he could do. He said that it is not advisable to prohibit overnight parking for safety reasons. It was also noted that vehicles have always been allowed to pull off the road along 191. Both Phil and Dale agreed to try and work together with Greg Adams help to mitigate the issues of concern to both parties. Other issues were discussed with Dale related to road work needed in Monticello and on Hwy. 191 South of Bluff, which is in great need of repair. The Commission said that with the new Planning and Zoning Commission it will be made clear that developers have the responsibility to put in turn lanes when there will be an impact on State roads. Bruce Bunker will make sure that Dale gets a copy of the regulations. Ben Nielson - SJC Planning Office Ben is working with the Monticello Chamber of Commerce to produce the San Juan County Heritage Festival. This is a week long event to be held from May 28th through June 2nd and will include a photography contest, a pool tournament, archery, 5K Run, horse trail rides, trail walk/hike, ATV ride, classic auto and tractor show, Sk8-a-palooza, dutch oven cooking contest and concert. Ben said that he has $1,300 toward entertainment and advertising for the event but that he is somewhat short on funds and asked if the Commission had suggestions for additional funding for the event. Commissioner Stevens suggested that the County provide $500 from the General Fund and that Charlie DeLorme may be able to provide another $500 either from the increased transient tax or from grant money that may be available. Ben said, in the future, he has plans to include Native American pottery and jewelry making, a pioneer pageant and a horse show at the event. Although the Festival will take place in Monticello, he sees it as being a County event. Commissioner Lynn Stevens made a motion to approve funding for the Heritage Festival in the amount of $500 from the County General Fund. Commissioner Kenneth Mary boy seconded the motion and Commissioner Bruce Adams declared the motion carried by unanimous vote. Open Time and Other Business Greg Martin, Assistant Manager, City of Monticello, received an e-mail that there will be a photo opportunity with the USDA highlighting the Wind Project that the County and City have been working on. It will be at 3:00 p.m. this afternoon and Greg invited Commissioners to attend. Since Commissioner Adams has been very involved in the project, he will attend. Greg also went over details of the Partnership Contract related to the Visitors Center and noted that there were some discrepancies in the agreement but the financial chart was correct. Commissioner's Reports Commissioner Maryboy had planned to be at the UAC Conference in Logan but the Navajo National Council was in session and there were some pressing issues related to extending the council position from four to six years (which was tabled) and other issues of concern. He noted that The Navajo Nation Sovereign Day celebration was held on Thursday. He attended the Mexican Water Chapter Meeting and it was brought to his attention that there is no Alarm System in the area and due to rapid climate changes they are requesting an Emergency Alarm System for the Montezuma Creek and Bluff areas. He plans to attend the Economic Development Committee Meeting where the Marina at Antelope Point will be discussed. Commissioner Stevens attended UAC Leadership meetings and said they were quite productive. He said that he will attend the All Hands Gathering to address the Visitors Center and Vendor Village tomorrow. He will participate in "Farm Days" events on Friday of this week and will have his horses at the event. Farm Days will be held this Thursday and Friday. Commissioner Stevens will attend the Public Lands Coordinating Council Meeting on Wednesday morning and is scheduled to attend a meeting on May 14th with Jeff Alexander and others related to highways. He will be in Daggett County on the April 30th . Commissioner Stevens questioned two actions taken by the SJC Commission relating to the Park Service. One related to expanding the parking lot near the White Rim Trail and the other was support for making the road in Rustlers Valley a walking trail. Apparently letters of support for the two actions were not received. Norman Johnson will research this issue. Commissioner Bruce Adams, along with Lynn Laws, met with the Grand County Council regarding roads in Spanish Valley. He spoke with Dal Hawks from UDOT. They discussed building four turn out lanes in Spanish Valley and Commissioner Adams discussed Wilson Arch issues with Dale. He attended the UCIP Board Meeting on Tuesday and on Wednesday, Thursday and Friday attended the UAC Conference. He felt the meetings were very productive. He plans to attend the Joint Highways Meeting in St. George tomorrow. Commissioner Stevens and Adams reported that there are two openings on the Statewide Wildlife Board. If San Juan County is eligible for a seat on the board, it would be an advantage to have someone represent San Juan County, especially the Native American Community. The deadline to apply is May 4th. Commissioner Maryboy said that he is interested in applying if eligible. It was recommended that Rick Bailey be recommended to UAC for recognition for his work during the emergency at Navajo Mountain.
