SAN JUAN COUNTY COMMISSION MEETING August 6, 2007 The regular meeting of the San Juan County Commission was held on August 6, 2007 At 10:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman Johnson, SJC Clerk /Auditor Dianne F. Neuss, SJC Deputy Clerk Attendees: Walter Bird Bob Bushart Neil Joslin Joe Barton Mike Adams Earl Lee John Bell Commissioner Kenneth Maryboy made a motion to approve the minutes of July 23, 2007 with corrections. Commissioner Lynn Stevens seconded the motion. Commissioner Adams declared the motion carried by unanimous vote. Cyndi Eldredge - SJC Human Resources Cyndi requested approval of an increase in Shurrell Meyer's compensation reflecting her new responsibilities as Acting Interim Director of the SJC Library. After review, it is recommended that promoted to a Grade 11, Step 81. The Library Board wants to advertise for a Library Director as well as create a new full time Librarian position for the Blanding Library. The Commission advised that there are budget issues that must be considered before a new position is created. Commissioner Lynn Stevens made a motion to approve the increased compensation for Shurrell Meyer during her time as Acting Interim Director of the SJC Library. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Cyndi reported that she advertised in house for the Librarian position at the Monticello Library and received two applications from SJC employees. After discussion, it was recommended that members of the Library Board review the two applicants before advertising the position. This is in following the County's Personal Procedures. Cyndi will contact the Joella Krall, Library Board Chair, and inform her of the Commission's recommendation. Cyndi reported that Erica Shumway, Library Assistant at the Blanding Library, also submitted her resignation effective on August 17th. Cyndi presented a short Press Release for approval concerning the County's excellent safety record of 600 days without lost time injuries. The Commission expressed their appreciation to County employees as well as to Cyndi for this excellent accomplishment and approved the Press Release as written. Cyndi will attend the UCIP Risk Management Conference in Cedar City from August 14th - 16th. She also noted that she has been working on providing employee badges for all County employees. The only badges that still need to be done are for EMT employees and for the Sheriff's Department employees. The Sheriff's Department will provide badges for their employees, as they need to include specific information. Cyndi surveyed all County employees asking for their input regarding providing orthodontia coverage to the dental benefit. Of the 140 questionnaires sent out, 59 were returned with 40 voting in favor and 19 not in favor. If this coverage were provided, it would allow $1,000 per covered individual for orthodontia dental procedures. This would be a one-time payment per individual that could be paid over several years. There would be no increase in premiums for employees, but the County would be responsible for payment of this benefit. After discussion, it was decided that more time should be given for responses to come in and address the issue at a later date. Evan Lowry - SJC Planning Office Evan updated the Commission on the Clay Draw project. Lee Bennett finished her archeological study of the area in question and found no archeological issues. Lee's report will be submitted to the BLM in order to obtain a permit. Before the permit is issued, the State Historical Preservation Office will need to give their approval. Lee indicated that the actual dam site will have to be studied when the time comes. Evan reported that about sixty individuals attended the Wild and Scenic River Open House held in the Commission Chambers on July 26th. To qualify for designation as a Wild and Scenic River, three criteria need to be met; a river has to be wild, scenic and provide recreation opportunities. The Commissioner's discussed the issue of this designation and determined that the two areas that qualify in our County are Mill Creek and Rock Creek. Since most of the areas are already set aside by the Park Service, there is no need for additional designation and the accompanying restrictions. Evan said that he received a letter from Garfield County asking for the County's support for the designation of other areas in the northern part of our County as Wild and Scenic. After discussion, the Commission was unable to comply with their request. Commissioner Lynn Stevens made a motion to request Evan to respond to U.S. Forest Service letting them know that our SJC opposes designation of the areas in question as Wild and Scenic Rivers. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Stevens indicated that he will be meeting with Selma Sierra on Wednesday and invited Evan as well as Commissioner Adams and Maryboy to attend the meeting. Norman Johnson - SJC Clerk/Auditor Norman presented two contracts from the Lieutenant Governor's office for signature relating to the upcoming elections in November and in February. The election in November is for the Municipal Officials and the School Voucher Referendum. Norman indicated that the County will receive a $24,000 grant for the election in November in addition to $2,500 from Blanding City and $500 from the City of Monticello. The second contract is for $24,000 for the Presidential Primary to be held on February 5th, 2008. Commissioner Lynn Stevens made a motion to approve for signature the two contracts for the elections in November of 2007 and for February of 2008. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Joe Barton - Bull Hollow Raceway Mr. Barton, the owner of the Bull Hollow Raceway, expressed his appreciation for the great job the County's Ambulance Service employees do, especially for Linda Larson, EMS Director. Mr. Barton explained that his business is finally picking up and breaking even after two years. He asked if the County could give consideration to forgiving his $10,000 ambulance debt for the last two years. He indicated that SJC's various businesses benefit from the raceway activities which draw many individuals to the County. In the future he would like to contract with the County on a yearly basis for Ambulance Service. After discussion, although Commissioners are sympathetic and realize the benefit the Raceway is to the County, forgiving the debt would severely impact to the Ambulance budget. Commissioner Adams suggested that Linda discuss the issue with Charles DeLorme, SJC Economic Development, and find out if the TRT could be used to help pay off the debt over time or if there are other funds available. Linda will discuss the issue with Charles and contact Mr. Barton. Bob Bushart made a suggestion that it may be possible to increase ticket prices by $1.00 to generate funds to cover the debt. Public Hearing - Proposal for a Change in Zoning 11:00 A.M. - Commissioner Lynn Stevens made a motion to go into Public Hearing to address the Zoning Change requested by Steven Redd. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Stevens questioned the details of the request for a zoning change. Mr. Redd would like to change the zoning from Agriculture to Commercial to accommodate a youth Residence Treatment Center for male and female teens in Old LaSal. No objections were received from neighbors in the area. Commissioner Adams asked if anyone present had objection to the change in zoning. There were none. Commissioner Lynn Stevens made a motion to exit the Public Hearing. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Lynn Steven made a motion to approve the zoning change request to allow for a Residential Treatment Center to be established on Mr. Redd's property in Old LaSal. Erikson - Lot 11, Mountain View Subdivision, La Sal Mountain - Cabin Commissioner Kenneth Maryboy made a motion to approve the building permits provided all appropriate signatures are placed. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Lynn Stevens was absent for the vote. Mike Adams and John Bell, representing the Elk Meadow Subdivision, had two requests. The first is for approval and signature of an amendment to the Elk Meadow Plat. Since the sewer and water system is an engineered system, it requires the signature of an official of the Elk Meadow Special Service District. Mike and John checked with Walter Bird, SJC Attorney to see how this could be handled since the Elk Meadow Special Service District has not been formed as yet. Walter advised that the San Juan County Commission retains authority and oversight acting as the Administrative Control Board until such time as Board is formed for the Special Service District. Mike noted that a letter from the State's Environmental Department has been mailed to the Commission indicating approval of the amendment to the original Plat. Commissioner Bruce Adams, in the interest of full disclosure, indicated that Mike Adams is his brother but he has no financial interest in the Elk Meadows Subdivision. Commissioner Stevens noted that Commissioner Adams does not need to recuse himself from voting on issues related to the Elk Meadows Subdivision. Commissioner Lynn Stevens made a motion to approve and sign the amendment to the Plat and in addition to signing for the Health Department acting as the Authority for the Elk Meadows Special Service District. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Since there was an issue with ownership of the property, John Bell presented the Commission with a Power of Attorney which was reviewed by County Attorney Craig Halls and Attorney Walter Bird. This was necessary for the Plat to be recorded. They requested verification of the procedure to be followed to annex an additional 60 acres and then another 40 acres for inclusion in the Elk Meadows Subdivision. Rick said that a Public Hearing would need to be scheduled to address each of the annexations before the Commission could vote on the request. Rick presented two Homeland Security funded procurement requests for Commission approval. The first is for a Toshiba Satellite P200 Computer for the Navajo Nation Department of Emergency Management at a cost of $1,447.55 and the other is for sixteen (16) Canon Portable Printers at $249 each for use with the Sheriff's Department's laptop computers. He recommended both purchases be made from Toshiba. Commissioner Lynn Stevens made a motion to approve the requested procurements for a Toshiba Satellite P200 Computer for the Navajo Nation Department of Emergency Management at a cost of $1,447.55 and for the sixteen Canon Portable Printers for the Sheriff's Department. Rick requested approval for the purchase of a Jaws of Life Power Unit for the new Hazmat/Rescue Truck. The funding for this equipment is part of a USDA Grant. The only source for this equipment is LN Curtis & Sons and the cost is $34,900.72. Commissioner Lynn Stevens made a motion to approve the purchase of a Jaws of Life Power Unit for the Hazmat/Rescue Truck from LN Curtis & Sons in the amount of $34,900.72 to be paid from USDA grant funding. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Rick presented a procurement request for the Road Department. The request is to purchase 25 1x1 x10.5 ft. Concrete Cattleguard Timbers and for 25 1x1 x14.5 ft. Cattleguard Timbers. Three bids were submitted with the low bid from Mikel Moses, of Blanding, at a total cost of $9,065. Rick recommended purchasing the Concrete Cattleguard Timbers from Mikel Moses. Commissioner Lynn Stevens made a motion to approve the procurement of the Concrete Cattleguard Timbers from Mikel Moses at a cost of $9,065. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Applications for vacant positions on the SJC Library Board were received from Sheryl Soderstrom and Susan Taylor of Monticello. There was a question regarding the number of board members and the areas represented and it was determined that two at-large positions were vacant. Commissioner Lynn Stevens made a motion to approve the appointment of Sheryl Soderstrom and of Susan Taylor to the SJC Library Board to fill the two at-large positions. Commissioner Bruce Adams seconded the motion and declared the motion carried by unanimous vote. Commissioner Kenneth Maryboy was absent for the vote. Rick received notification from UAC asking if the County would provide them with feedback regarding setting aside .1% of sales tax for road improvement. The plan would do away with rural hospital tax. Since we do not have a hospital tax, it would not benefit us, but the Commission asked that Rick to respond letting them know that the County agrees with the plan. Rick said he met with the members of the Spanish Valley Water and Sewer Agency. They are in support of putting in a sewer plant system and will try and find funding for the project from the State and Federal levels. There will be a Luncheon on August 16th to meet with a Consultant regarding the project. Rick said that we could either contract with the Spanish Valley Water and Sewer Agency or form an Interlocal Agreement or expand the service district. Brian Torgenson, from SITLA will be here at 9 a.m. tomorrow to discuss water and sewer issues in Spanish Valley. Rick reviewed the County's travel expense reimbursement policy for Out of State travel comparing it to reimbursement provided to Federal and State employees. At present, the County rates of reimbursement for expenses are low when traveling to large cities around the country. A proposal with the new rates of reimbursement will be distributed to Department Heads for their input. If the rate is raised it would have a minimal financial impact on the County. Commissioner Adams said that the San Juan School District contacted him because they are having problems with vandalism at the old building in Montezuma Creek.. The roof is also caved in and the building is unsafe. The San Juan School District had intended to build a gym at the site. Rick will talk to Clayton Holt and discuss the issue with him. The building was originally owned by the BIA and Navajo Nation but the San Juan School District obtained a long term lease. Even if the building is demolished, it was decided the San Juan School District should not give up the lease. Tammy Gallegos - SJC Director of Aging Tammy requested approval for the purchase of two vans for Bluff Senior Center. The funds for the vans were allocated by the Utah Navajo Revitalization Fund. The total cost is $39,117.90 for a mini van and for a twelve passenger vehicle. Commissioner Maryboy suggested the purchase of a used pick up truck to haul garbage so that other vehicles will not have to be used for this purpose. Tammy said that the first priority is to purchase the vans for the Seniors. Commissioner Kenneth Maryboy made a motion to approve the purchase of the vans for the Bluff Senior Center. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Stevens was absent for the vote. Tammy presented two contracts for Commission approval one for the DHS Pass Through for Aging Services and the other for the DHS Pass Through for the Medicaid Aging Waiver. Commissioner Lynn Stevens made a motion to approve and authorize the Commission Chair to sign the two DHS Pass Through Contracts. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Earl Lee - Manager, Southern Navajo Fair Earl reported on the status of the Navajo Fair and distributed a handout detailing the proposed budget. He requested that the Commission consider contributing additional funds for the fair based on the costs so far. Commissioner Adams reviewed the history of the County's contribution of funds for the fair and explained that the $30,000 budget for the fair cannot be increased this year but a new budge proposal could be presented in November for next year's fair. He explained that $5,000 of the $30,000 is for management of the fair and $25,000 is for the fair costs. In addition to the funds the County provides, any funds collected for events at the fair, including vending fees, admission fees, sponsorship, etc. can be used to pay for the fair. Last year approximately $10,000 was raised in this way. Earl also discussed the Fairgrounds and design problems and safety issues relating to rodeo events. Commissioner Adams informed Earl that the County spent approximately $20,000 to improve the arena in addition to helping to facilitate maintenance last year. He noted that the Arena is owned by the Navajo Trust Fund. Commissioner Stevens said that consideration needs to be given to any safety issues but that the configuration of arenas are diverse and that it is common for individuals participating in the events to have to adjust to the specific arena. Earl said that Charlie DeLorme has been a big help with the fair and is trying to get Bluff businesses to contribute. The Southern Navajo Fair is scheduled for September 13th to the 16th. Earl also brought to the Commissions attention several motorcycle accidents that have occurred recently on highway #262 between Aneth and Bluff. He recommended that a sign indicating a sharp curve be erected. Commissioner Maryboy indicated that he is concerned about this issue and after a discussion it was recommended that a the Chapter pass a Resolution requesting a sign to be erected and forward it to Rick Bailey and he will submit it to UDOT. Open Time and Other Business Bob Bushart expressed his concern that they are surveying for cell tower placement at the edge of Bluff and he and others in the community are concerned that if a tower is placed in that location, it will dominate the skyline. He questioned why it was not being erected across the river as was originally planned. He and others are also upset that there has been no communication to Bluff residents concerning the plans for a cell tower. Charles DeLorme was contacted by phone and said that the location of the cell tower has not been determined as yet and that three locations are being considered. He said that there were problems with reception in the originally planned location across the river. He said that after surveys are completed they will have a better idea of where a tower can be placed with the maximum benefit and at that time, a public hearing may be scheduled but this would be under SITLA guidelines. Commissioner Lynn Stevens made a motion to approve a Resolution to be written accepting a Grant from the Gates Foundation for eleven new computers indicating the oversight of the Library Board. Commissioner's Reports Commissioner Maryboy attended the Navajo National Council Budget Meetings and also attended a meeting concerning the Antelope Point Marina and it is 98% completed. He visited some elderly Native Americans and attended their ceremonial functions. They were very pleased to have a County Commissioner visit with them. He also traveled to Farmington last Thursday to meet with a law firm there and a letter was written to the State of Utah concerning obtaining a Class 2 Gaming License for Montezuma Creek. He noted that there are five bingo halls in Salt Lake City but no one seems to acknowledge them. The last step will be to meet with the Governor and with the Attorney General concerning the issue. Commissioner Adams will attend the Ribbon Cutting Ceremony for the San Juan County Fair which will be held Wednesday at 7:00 p.m. He will also attend the Mark Wills Concert and the Rodeo and other events. Next Monday he will attend the UCIP Board Meeting in Cedar City. Commissioner Stevens will leave for SLC on Tuesday night and be there all day Wednesday.
