SAN JUAN COUNTY COMMISSION MEETING September 17, 2007 The regular meeting of the San Juan County Commission was held on September 17, 2007 At 10:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman Johnson, SJC Clerk /Auditor Dianne F. Neuss, SJC Deputy Clerk Attendees: Marilyn Boynton, Bob Bushart, Jim Harden, David Carpenter, Susan Taylor, Howard Randall, Toni Turk, Clayton, Long, Clyde Jones Commissioner Lynn Stevens made a motion to approve the minutes of September 10, 2007 with corrections. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried. Clyde Jones - Larson & Company - SJC 2006 Auditor's Report Clyde Jones, with Larson & Company, presented the Commission with the 2006 Audit for San Juan County. The audit was conducted according to government standards and covered two areas: Compliance and Internal Controls. Clyde was very pleased to report that in both areas there were no items to report. In addition, all State requirements for compliance were met. He said there were three immaterial items that were identified but they had no dramatic impact. The three items were discussed relating to proof of publication of the Budget Hearing, the TD693 Report, and the June 30th due date for submission to the State. These were all items that can be addressed. Clyde thanked Norman, John and everyone for their outstanding cooperation and help. Commissioner Lynn Stevens made a motion that we accept the 2006 Audit Report submitted by Larson and Company. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Maryboy was absent for the vote. Walter Bird, Attorney - SJC Human Resources Walter reported that interviews were conducted last week for the part-time position of Aging Waiver Assistant Case Manager/ Ombudsman and requested approval to hire Brittney Dalton for the position, at Grade 22, Step 173. Commissioner Lynn Stevens made a motion to approve the recommendation to hire Brittney Dalton for the Aging Waiver Assistant Case Manager/Ombudsman position. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Kenneth Maryboy was absent for the vote. Walter requested approval for a salary increase for Charles DeLorme, SJC Director of Economic Development. This request was tabled at last week's Commission Meeting to give Rick Bailey a chance to review the request. Rick said he reviewed the proposal and had no objections. The salary adjustment is from Step 199 to Step 250 with the appropriate salary increase. Commissioner Stevens noted that, at last week's Commission Meeting, there were concerns about the budget process being interrupted by injecting new budget increases in the middle of the budget cycle. Even though the Economic Development budget is more than adequate to accommodate the salary increase, it was noted that Mr. DeLorme's job responsibilities have increased since he was hired. Commissioner Stevens also had the opportunity to communicate with the Director of State Tourism and staff who all agreed that Mr. DeLorme's performance exceeds other Economic Development Directors statewide. Commissioner Adams agreed with the action taken on Mr. DeLorme's behalf, but had some questions about the process. He expressed the Commission's reliance on Human Resources for guidance when requesting salary increases outside the usual process. He is concerned that Commission salary decisions do not cause problems down the road. Walter noted that the three last salary adjustments occurred due to extraordinary circumstances. He said that he agrees with the need to follow the process, but salary increases need to be made to correct inequities, or in the case of a change in job responsibilities. Norman questioned the comparisons used in making salary adjustments. He is concerned that we may be setting a precedent when we compare salaries statewide and thought there may be a potential for requests from other County employees for salary increases based on statewide comparisons. Walter said that for some County positions, the only place to compare salaries is statewide, as in the case of Mr. DeLorme's position. Commissioner Lynn Stevens made a motion to approve the salary increase for Charles DeLorme from a step 199 to a step 250 with the appropriate compensation. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Charles DeLorme - SJC Economic Development Charles presented a draft of a letter of support to the National Park Service for Commission consideration. The letter is in support of the co-location of an Antenna, similar to what Commnet provides, for the new NPS location. The current cell tower at Navajo Mountain is a Verizon Tower and is in trespass. The NRCC potentially would like to take down the tower and has approved a new tower location for the National Park Service. Charles received a verbal commitment that they would allow the co-location from a commercial operator. It would greatly expand the coverage area and expand convenience for users. It was recommended that the letter of support be reviewed by Leo Manheimer, President of the Navajo Mountain Chapter, for his information and so that he can inform members of the Chapter about the plan. It was noted that the Navajo Nation already approved the plan. Charles will contact him and fax him a copy of the draft. Commissioner Maryboy said that if it is already approved by the Navajo Nation, there should be no problem. Charles reported that he facilitated co-location on three tower locations: Abajo Tower, the Blanding Alltel Tower and the Aneth Cell-One Tower, all with Commnet. This will greatly expand the coverage area. On the controversial Bluff Tower location, Charles contacted Kim Christy, Assistant Director of Trust Lands Administration, as well as Brian Torgerson and asked them to arrange for a public comment meeting in Bluff as the application process goes forward. He spoke to Brian this morning and found that they did receive an application for a Trust Lands site in Bluff and again he again agreed to hold a public comment meeting for Bluff residents. Charles complimented Commissioner Maryboy and Earl Lee, Navajo Fair Manager, for all their work to put on a very successful and well-attended fair. Charles expressed appreciation for the support that he has had from the Commission, from Rick and everyone on staff, making his job easier. He would like to keep the communication open. Commissioner Adams noted that FSN televises the Red Bull Races every Sunday and that this Sunday the race will be in San Diego, CA. Commissioner Stevens said that most of the races are over water, except for the one held at Monument Valley. Marilyn Boynton - SJC Resident Marilyn brought up several issues. The first was in regard to the sewer plans in Bluff. She said that she was misinformed and submitted incorrect information regarding "lagoons" to the San Juan Record. Marilyn went on to explain the misunderstanding. David Carpenter said that the three different plans were discussed in detail at the last Service District Meeting. Marilyn also discussed a book that she found, written in 1994, detailing information gathered regarding the desire and the direction that the community of Bluff wanted to follow. The majority of residents, at the time, moved to Bluff for its beauty and expressed the importance of maintaining the scenic beauty. She noted that although she realizes that a cell tower is needed to provide service for residents in the area, she hopes that a suitable site could be found that would not hinder the views. The third issue was Flood Plane Mapping. Since the County does not have a map of the flood plane, she asked if the Commission would allow her to contact the USU and find out if someone there would be interested in developing a Flood Plane Map, possibly with the help of University students. She said that it would be an advantage for planning and development in the County when approving building plans. The Commission had no objection to Marilyn working on this project. Commissioner Stevens, Toni Turk, Clayton Long Toni Turk, Mayor of Blanding and Chair of the SJC Homelessness Committee, discussed the role of the Homelessness Committee and what they have accomplished over the time they have been in existence. He said that a representative from the State comes to most of the meetings and that the focus is to identify the areas in the County where homelessness is a problem and develop a 10 year plan to address the problems. The defining criterion for homelessness in our County is mainly persons who live in substandard housing, with some, or no utilities. The Westwater Community was identified as needing the most representation. Since Mayor Turk is resigning his position as Chair of the Committee he suggested and recommended Clayton Long to Chair the Committee. Clayton has been communicating with the Westwater Community to identify their wants and needs. Mayor Turk also noted the need to understand the bureaucracy in the different areas of the County, as a beginning, to try and help the homeless. Commissioner Stevens, who is a member of the Homelessness Committee, noted that he has been aware of the Westwater area since he was a child and agrees that the focus should be to help the community join together to decide how to go forward. He said the land is owned by the Navajo Nation, and surrounding communities have attempted to improve the lot of the residents in the past. They have never gotten as far as they have since Clayton has been involved. He is in agreement with Mayor Turk that Clayton would be an asset as Chair of the Committee. Commissioner Maryboy agreed that Clayton should be named Chair of the Committee. Commissioner Lynn Stevens made a motion to approve the assignment of Clayton Long as Chair of the Homelessness Committee upon the resignation of Mayor Turk. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Evan Lowry - SJC Planning Office Evan reported that Selma Sierra, BLM State Director will be in Grand County on October 10th and 11th. He arranged with Shelly Smith, Acting Field Manager for the Moab District, for Selma to come to San Juan County to meet with Commissioners at 9:00 a.m. on September 11. After discussion it was decided that it would be more convenient, due to scheduling, for Commissioners to meet with Ms. Sierra in Moab on September 11th. Evan verified some of the topics of discussion for the meeting. Evan said that Ms. Sierra is planning another trip to San Juan County at a later date. Shelly Smith also offered to meet with Commissioners to discuss the RMP draft. It was decided that the meeting should be arranged for October 8th or 22nd, in the afternoon following the Commission meeting. The Moab BLM office will have a test run with their staff on October 18th to see what people would like to know before they hold the Open House on October 26th at the Monticello High School between 6:00 to 8:00 p.m. There will also be an Open House at the Grand Center in Moab on October 25 from 6:00 to 8:00 p.m. Glen Canyon Recreation will also hold an OHV Open House next Monday at the Welcome Center in Monticello from 4:00 to 7:00 p.m. Evan said he attended a meeting regarding the roads that should be open for OHV use in the Glen Canyon area. He noted that it was determined that Halls Crossing roads should not be open to OHV use. Commissioner Stevens asked that Evan provide information about the relevant issues as he will be meeting at Lake Powell on the September 27th and 28th with Glen Canyon Management. Evan presented a draft proposal to amend and update a portion of County's Master plan. He asked that the Commission review the draft and return it to him with any comments or suggestions. There may be some things that we want to clarify and there will need to be Public Comment scheduled. Rick Bailey - SJC Administrator Rick presented five building permits for approval and signature. Rick presented a request for approval to accept Cottonwood Ave and 2nd North from 8th West to the gravel intersection, Copper Cliffs Subdivision, into the County Road System. Lynn Laws, County Road Superintendent, gave his approval for the addition. Human Resources held a hearing for the Sheriff's Office employees on August 28, 2007 at 9:00 a.m. to address the issues related to transferring participation from the Public Safety Contributory System Insurance to the Public Safety Non-Contributory System Insurance. The group agreed to transfer to the Public Safety Non-Contributory System which needs Commission approval and signature. Commissioner Lynn Stevens made a motion to authorize the Commission Chair to sign the Transfer Form changing participation from the Public Safety Contributory System to the Public Safety Non-Contributory System. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. The Commission received a request for approval for the Area Plan and Award of Funding Allocation for State Fiscal Year 2008, from the Department of Human Services, Division of Substance Abuse & Mental Health, Contract #060258 - Amendment #1, in the amount of $269,581. Commissioner Lynn Stevens made a motion to approve the DHS/DSAMH Contract #060258, Amendment #1 for Fiscal Year 2008 in the amount of $269,581. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Open Time and Other Business David Carpenter, Bluff Service District, said that a letter was received from the owner of the building the District is utilizing. The letter identified maintenance problems in the building and the Service District is in the process of taking care of these problems. He noted that the owner is responsible for janitorial services and for housing the janitorial supplies. The District found it necessary to utilize the closet that was housing the janitorial supplies for equipment and advised the owner of the lease agreement relating to the supply closet. Commissioner's Reports Commissioner Stevens attended the Native American Summit in Cedar City last week where very comprehensive reports were given in the three subject areas of education, health provisions, and economic development which reflected an enormous amount of work done in these areas. He attended the Utah Navajo Trust Fund Board of Trustees Meeting on Friday at Navajo Mountain and there was a good followup report on the circumstances on the mountain concerning water and roads. Saturday he and his wife road horses in the parade along with Commissioner Adams and his family. He will be in Price early Wednesday at the Board of Trustees Meeting for the College of Eastern Utah and then will travel to Midway for the Utah Association of County Commissioner and Councilmen Conference on Thursday on Friday. He will be out of town next week and will not attend the Commission meeting. Commissioner Maryboy reported that members of the Navajo Nation Economic Development Committee were never informed of the Native American Summit but were pleased that Commissioner Maryboy was able to attend. He attended the Navajo Commission Meeting and the State is requesting another meeting to discuss water right issues. He reported that the Navajo Fair went very well and everyone was pleased that Commissioners Adams and Stevens participated riding horses in the parade along with their family members. The Rodeo and the Motorcycle Race were very well attended, as were the other events. There are plans to move the Fair to Monument Valley or Aneth beginning next year. Commissioner Maryboy appreciated the assistance of the EMT's and Sheriff's Department during the Fair. He will be in Window Rock tomorrow and will travel to Midway to attend the Association of County Commissioners and Councilmen Conference on Thursday and Friday of this week. Commissioner Adams attended the Native American Summit in Cedar City as well as the Utah Navajo Trust Fund Board of Trustees Meeting at Navajo Mountain last Friday. He attended the Oljato Meeting yesterday and the RAC Meeting last Wednesday. He will attend the Utah Association of County Commissioners and Councilmen Conference Meeting in Midway on Thursday and Friday. The Tomhave Group intends to submit an outline of testimony to the legislative subcommittee relating to the National Status of Safety of Bridges, with Commission approval, along with testimony from the Navajo County, AZ. Bridges on the Reservation and in rural areas are not included on the schedule and this is an effort to rectify the omission. Commissioner Stevens made a motion to authorize the Tomhave Group to act in the County's behalf with regard to bridges on the Reservation and in rural areas. Commissioner Maryboy seconded the motion.
