SAN JUAN COUNTY COMMISSION MEETING May 12, 2008 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk/Auditor Dawn Shaw, SCJ Deputy Clerk Attendees: Marilyn Boynton, Kelly Burke, Kris Hurlbert, Bryan Hurley, Charlotte Hurley, Greg Adams, Bill Boyle, LaVern Tate, David Bronson, Walter Bird, Tammy Gallegos A motion to approve the minutes of May 5, 2008, with corrections to be made by Commissioner Kenneth Maryboy, was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. LaVern Tate - SJC Historical Society LaVern presented a request to have Sam Cantrell, from the SJC Survey Office, use up to three days of paid time in researching the surveyor's records of Butler Wash, Comb Ridge, Comb Wash for the Euroamerican uses and make the information available to Winston Hurst and Robert McPherson. The Commissioners stated that David Bronson, SJC Surveyor, needed to give his okay. David said he wouldn't have a problem with Sam doing this. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. Norman L. Johnson - SJC Clerk/Auditor Norman updated the Commission on the schedule for the Primary Election giving them a detailed calendar of events. The Commissioners complimented Norman and thanked him for all his hard work on elections. Norman presented an out of state travel request to go to Albuquerque, NM June 10-13 for the US Election Assistance Commission Meeting. The EAC will pay all travel costs. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. -1- Norman presented the 2008 Central Assessed Valuation for Commission review. Even though the value is up 81.9 million he stated that there are a couple areas of concern that he and the Assessor will look further into. Bryan Hurley - Bridger Jack Mesa Property Owners Association Bryan expressed concern to the Commissioners about proposed exploration and mining on private property and BLM lands. He said that when SITLA sold surface rights to developers they retained mineral rights which could be leased to mining companies. Bryan, on behalf of himself and other property owners in the Bridger Jack Mesa area, asked for guidance from Commissioners on getting a buffer zone between residential areas and mining areas. The Commissioners stated that Mr. Hurley has legitimate right to be concerned and Commissioner Stevens said he would look further into this and get back to Mr. Hurley. Tammy Gallegos - SJC Administrative Assistant Tammy presented the Ombudsman Contract with SEUAOG, that was approved at the April 28, 2008 Commission Meeting, for signature. Rick Bailey - SJC Administrator Rick presented one building permit for signature and approval. Hole in the Rock Foundation - Bathroom Remodel - Hwy 191, Bluff A motion to approve the building permit, provided all appropriate signatures are in place, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented the BIA Road Maintenance Contract for approval and signature. A motion to approve signature of the contract was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented the Dog Ordinance for approval and signature. ORDINANCE NO. 2008-01 AN ORDINANCE REGULATING THE OWNERSHIP, LICENSING, ENFORCEMENT AND CONTROL OF DOGS IN UNINCORPORATED SAN JUAN COUNTY (The entire ordinance as adopted is an attachment to the minutes) A motion to adopt the Dog Ordinance, with the provision that it should have the same wording with regard to State Law on dogs that are a nuisance to domestic animals (that owners can shoot the dog) and the appropriate county code numeration is placed, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick indicated to the Commission that he has talked to Chamberlain and Associates about an -2- indoor Equestrian Center. Chamberlain and Associates have some experience with this and agreed to meet with local officials about this on a cost per hour basis. Rick reported to the Commission that Brandy and Jeff Tomhave will be here next week and they would like a list of people they could meet with about issues concerning the County. Rick reported to the Commission that USDA is going to Navajo Mountain, sometime in July, to start repairs on the water system. He would like to advertise for a temporary CDL Driver to haul water during this time. Commissioner Maryboy is going to follow up on getting the funds from the Navajo Nation from the last time the County hauled water at Navajo Mountain. Open Time and Other Business Myron Lee, Monticello City Manager, presented a request to change the zoning on the East side of Highway 491, directly across from the Monticello Airport, to be zoned with a buffer for the future Monticello Airport. Commissioners asked Myron of the an outline of what area the zoning needs to cover. The next step would be to hold a Public Hearing and inform land owners in the area of what they plan. Commissioners discussed the proposed Wellness Center in Blanding saying they are unsure whether or not CEU is going forward with their plans. Commissioner Lynn Stevens made a motion for $250,000 to go to CEU if they decide to build the Center. Should CEU not build the money would then go to the City of Blanding, toward their Recreation Center, provided that they have funds coming in from other sources. The proposal would be to budget $50,000 per year for five years and be considered as last funding. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commission Reports Commissioner Stevens attended the UAC Dues Committee Meeting in Provo on Friday. They adjusted the formula for dues from 1.1% of the total budget to 1.2%, for small Counties, raising SJC's annual dues by approximately $1000. He will be participating in the Flag Ceremony at WIR Thursday the 22nd. Commissioner Maryboy reported on some alleged harassment on the Reservation. Following a discussion it was determined the County did not have jurisdiction. He also stated that the Bronc School went really well and everyone had a good time. Commissioner Adams, along with Commissioner Stevens, attended the Republican Convention on Saturday. He will be attending the opening ceremony for the Clinic and Fire Station in Monument Valley on Friday. Then next week he will be attending WIR. Adjourn 12:00 P.M. -3-
