SAN JUAN COUNTY COMMISSION MEETING June 1, 2009 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room in Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chair Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk/Auditor Dawn Shawn, SJC Deputy Clerk Attendees: Jerry McNeely, Charlie DeLorme, Scott Burton, Larry Sorrell, Howard Randall, Maxine Deeter, Mike Lacy, Alan Freestone, David Cressler, Cyndi Eldredge, Evan Lowry, Greg Adams, Mike Diem, Rex Anderson A motion to approve the minutes of May 18 and 26, 2009, with corrections to be made by Commissioner Kenneth Maryboy, was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. Cyndi Eldredge – SJC Personnel Cyndi presented a request to hire Benjamin Musselman as the Assistant Surveyor a full time Grade 15 Step 114 position with Ian Getter as the alternate. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Cyndi reported to Commissioners that UCIP is requiring an audit of all county fleet vehicles. She states that there are over 2,000 pieces of equipment and she has enlisted the help of Natalie Freestone to complete this by the June 30, 2009 deadline. Howard Randall – SJC Assessor Howard reported to Commissioners that the tax roles were closed and printed this morning. He stated there is a factoring order for Monticello and Blanding outside the five year cycle for updating the taxes on properties. Due to this order Monticello will see a 28% increase and Blanding will see a 25% increase. After much discussion Howard stated that he did write a letter of opposition to the Utah State Tax Commission and Commissioners stated they are 110% against this. Howard reported that Mr. Von-Khrum has protested his Mexican Hat property tax valuation and would like a BOE hearing with Commissioners. Commissioners asked if there was any new information on this property and Howard reported that there was not. It was decided that this request would follow the natural process of BOE and Commissioners would meet with him when they meet with everyone. BOE Hearings for 2009 will be held August 17 from 1:00 P.M. to 6:00 P.M. and August 24 from 1:00 P.M. to 5:00 P.M. Open Time and Other Business Charlie DeLorme, SJC EC. Development, presented an out of state travel request to participate in a Governor’s Trade Delegation and Marketing Mission to develop the new SLC to Tokyo nonstop flight in the amount of $2,092 to Tokyo, Japan. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Mike Lacy and Alan Freestone, SJC Sheriff’s Office, presented a request to have a waterline installed for the jail expansion. Lacy and Freestone stated that there is urgency to get this done soon as UDOT will be replacing Main Street soon. They reported that they received two bid requests with Musselman Plumbing being the lowest in the amount of $23,150. After a discussion a motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rex Anderson – SJC Resident Mr. Anderson reported to Commissioners that he has a 40 year lease on a piece of property in Hammond Canyon. He stated that he has a written authorization allowing him access to this property by horse but has requested that there be road access from the Forest Service. Mike Diem – US Forest Service Mike reported that a decision was made in 1991 to change the road access in Hammond Canyon to non-motorized. He stated that the Forest Service generally acts on requests from land owners, not leasees but that he is still working on the issue. Mr. Diem, Commission and Norman, representing the SJ Water Conservancy District (SJWCD), entered into a discussion concerning Dry Wash Reservoir and a potential increase in capacity. Mr. Diem indicated he would be the person to whom a proposal would be sent. Norman indicated that SJWCD, the City of Blanding, Blanding Irrigation Co. and the Boy Scouts of America are all interested in an expansion. Some of the water could be dedicated to fire suppression. Norman L. Johnson – SJC Clerk/Auditor Norman presented the minutes of the 2009 Tax Sale and recommended a tax deed be given to Don E. Smith on the Perkin’s property and the Brown property be struck off to the county and a tax deed prepared with all tax, penalty and interest being abated. Rick Bailey – SJC Administrator Rick presented a request for approval of a contract between the US Army Corps of Engineers and the County for work to be done on the Navajo Mountain Project Phase III. Rick presented a request to amend a contract between the County and UDOT. The contract addresses combining Phase II and Phase III of the Lisbon Valley project. Rick presented one building permit for approval and signature. Doyle Albers – Barn/Studio – Elk Meadows Subdivision, Monticello A motion to approve the building permit, provided that all appropriate signatures are in place, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented three procurement requests from the Road Department for approval. One from Tesco Williamsen for a Hi-Way E2500 Spreader in the amount of $12,586, this is to replace a spreader that was damaged in a wreck. One from Grainger for 7x12 Wet Band Saw in the amount of $1,034.10 and one from Wheeler Machinery for two Walk n Roll Packer/Rollers in the amount of $22, 110. Rick presented a request to reappoint four members, Steven Risenhoover, Ed McElhaney, Jared Shumway, and Brian Backus to the SJ Spanish Valley SSD. Rick reported to Commissioners the fifth position for the SJ Spanish Valley SSD will be advertised. Commission Reports Commissioner Maryboy reported that he attended a dinner at Commissioner Steven’s house with Lt. Governor Herbert. He drove through Mexican Hat and down towards Arizona on the VCA Road to check road conditions on the Reservation. Commissioner Stevens reported that last week he attended the WIR Conference in Pendlton, Oregon, a UAC Board of Trustees meeting, the Utah Board of Regence meeting and a CEU Board of Trustees meeting. This week he plans to be in the county and attend meetings to discuss land issues. Commissioner Adams reported that he met with the Nature Conservancy of Utah to discuss Clay Draw. This week he plans to attend a UCIP Board meeting and retreat in Springdale. He plans to be in the county most of the week. Adjourn 12:01 P.M. 2
