SAN JUAN COUNTY COMMISSION MEETING June 8, 2009 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room in Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chair Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk/Auditor Dawn Shawn, SJC Deputy Clerk Attendees: Larry Sorrell, Evan Lowry, Scott Mitchell, Scott Burton, Sue Bellagamba, Kent Rowley, Jerry McNeely, Brooke Williams, Liz Thomas, Tammy Gallegos, Howard Randall, Cyndi Eldredge A motion to approve the minutes of June 1, 2009 subject to changes made by Commissioner Kenneth Maryboy, was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. Kent Rowley – SJC Resident Kent reported to Commissioners that he owes $1,300 on back taxes for a piece of property that he had sold but the sale fell through and the property taxes were never paid and the property was taken out of greenbelt. He presented a request to have the back taxes abated back to greenbelt status. After a discussion it was decided that Norman Johnson, SJC Clerk/Auditor, would research this issue and report back to Commissioners at the next Commission Meeting. Open Time and Other Business Sue Bellagamba, Nature Conservancy, presented a request to approve a resolution to protect the sage grouse in San Juan County. Commissioner Adams stated that he would support the resolution with the caveat that it would not interfere with adjacent properties and the possibility of renewables, like wind and solar power, being put in. Commissioners also stated that their opinion is that predators, such as crows, pose a bigger threat to the sage grouse than any roads would. San Juan County Resolution 2009 – 02 A resolution in support of LeRay McAllister Critical Land Conservation Funds being used to protect habitat for Gunnison Sage-grouse in San Juan County, Utah. Whereas: San Juan County body duly organized under the State of Utah, (hereinafter the County) pursuant to the provisions of the Utah Interlocal Co-operation Act, 11-3-1 of the Utah Code; Whereas: the County is an active member of the San Juan County Gunnison Sage-grouse Working Group and has signed the Gunnison Sage-grouse Conservation Plan; Whereas: the Gunnison Sage-grouse is being considered for listing as an Endangered or Threatened species by the U.S. Fish and Wildlife Service; Whereas: the County desires to protect Gunnison Sage-grouse habitat while preventing listing by the U.S. Fish and Wildlife Service; Whereas: the County believes in safeguarding private property rights by using free-market principles to guide property transactions between willing sellers and buyers; Whereas: the owners of a tract of private property in the County desire to place a conservation easement on a portion of this property; Now, Therefore: be it resolved by the Board of County Commissioners of San Juan County that the County supports efforts to protect habitat for Gunnison Sage-grouse while also safeguarding private property rights by using LeRay McAllister Critical Land Conservation Funds to place a conservation easement on a tract of private property in the county. Howard Randall – SJC Assessor Howard presented a request to amend an interlocal co-op agreement between the county and the Multi County Appraisal Trust (MCAT). After a discussion Commissioner Lynn Stevens made a motion to approve the request, subject to review. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Evan Lowry – SJC Planning/GPS Evan reported to Commissioners that Earl Henry has been working on the photo comparison project and it will be at least a year before the second edition is printed. Evan presented a request to make some additions to the agreement between the county and the Forest Service. He stated that he would like to have three trails and one road added to the agreement for maintenance. A motion to approve the request was made by Commissioner Lynn Stevens. Tammy Gallegos – SJC Administrative Assistant Tammy presented three contacts for approval and signature. One with the State, two with Rocky Mountain for contract services for the alternative program and the care giver program. A motion to approve all three contracts was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Cyndi Eldredge – SJC Personnel Cyndi presented a request to hire Susan DeLorme as the Victims Advocate a full time position. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams. Rick Bailey – SJC Administrator Rick presented two building permits for approval and signature. Fenton Pehrson – Residence – Montezuma Canyon, Monticello Randal Purcell – Carport/Shed, E Flour Mill Rd, Blanding A motion to approve the building permits, provided that all appropriate signatures are in place, was made by Commission Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented a request to approve an agreement between the county and Utah Energy Corporation (UEC) to install and maintain a cattle guard on an existing county road. UEC has agreed to pay $3,500 for the installation and is required to maintain gates and fences attached to the cattle guard. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presents a procurement request from the road department for a 2006 CAT 613C Series II Elevating Motor Scraper in the amount of $82,500 from Ritchie Brothers Auctioneers, Inc. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented a request to amend the temporary lease agreement between the county and Commnet. Rick stated that the lease ended in July however Commnet would like to extend it to January 31, 2010. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commission Reports Commissioner Stevens reported that the issue about the evaporation ponds will have to go to a public hearing, held by the county, after it goes through Planning & Zoning. Commissioner Stevens stated that Forest Service plans to close several roads around Dry Wash. He will be out of the county most of the week attending meetings but can be reached by phone. Commissioner Maryboy reported that he plans to attend a Navajo Utah Commission (NUC) meeting on Wednesday. Commissioner Adams reported that he attended a UCIP meeting in Springdale last week and plans to attend the State Convention this week. 11:00 A.M. – Executive Session A motion to go into executive session, to discuss legal and human resources issues, was made by Commissioner Lynn Stevens.
